Man Wrongfully Imprisoned For 27 Years Will Sue His Accusers

Posted: 30 Dec 2019 08:00 PM PST

It was August 10, 1991. Outside Louie's Texas Red Hots restaurant, a group of men began fighting. A gun was pulled and Torriano Jackson was killed.

An anonymous tip led police to Valentino Dixon, who says police had been targeting him long before the shooting. Dixon was arrested, but just two days later, Lamarr Scott confessed to the shooting and murder of Jackson. Scott's confession did nothing to help Dixon, who was convicted of the murder and sentenced to 38-and-a-half-years to live in prison, according to a website set up for his defense.

While in prison, Dixon gained national attention for his beautiful artwork depicting golf courses. His story attracted the attention of Golf Digest in 2012, which wrote a story about his conviction and decided to help him win his freedom. In 2018, after 27 years in prison, Dixon was exonerated and released.

Orange County Man Charged with Federal Hate Crimes for December 28, 2019, Machete Attack at Rabbi’s Home

Grafton Thomas Injured at Least Five People in Attack During Hanukkah Observance

Eric Dreiband, Assistant Attorney General for Civil Rights, Geoffrey S. Berman, the U.S. Attorney for the Southern District of New York, and William F. Sweeney Jr., the Assistant Director-in-Charge of the New York Office of the FBI, announced today that Grafton Thomas has been charged with five counts of obstructing the free exercise of religion in an attempt to kill, a federal hate crime, related to his machete attack during Shabbat and Hanukkah observances at a Rabbi's home in Monsey, New York, on the night of Dec. 28, 2019. Thomas is expected to be presented in White Plains federal court later today.

"Every American should be free to live and worship in safety," said Assistant Attorney General Eric Dreiband for the Civil Rights Division. "The department will vigorously prosecute those who commit hate crimes, and we will continue to work with our state and local partners to bring to justice anyone who violates the civil rights of Americans."

"As alleged, Grafton Thomas targeted his victims in the midst of a religious ceremony, transforming a joyous Hanukkah celebration into a scene of carnage and pain," said U.S. Attorney Geoffrey S. Berman for the Southern District of New York. "Today is the eighth day of Hanukkah, the festival of lights that commemorates Jews' struggle to practice their faith more than two millennia ago. And we are about to welcome a new year. Even in the face of tragedy, both milestones are an occasion for renewed hope and resolve: To combat bigotry in all its forms – and to bring to justice the perpetrators of hate-fueled attacks."

"When an individual's actions cross the threshold of a federal crime, as we allege Mr. Grafton did here, we will act swiftly," said FBI Assistant Director William F. Sweeney Jr. "The message from today's charges should be crystal clear – the FBI won't tolerate violence against anyone. Working with our partners, we will hold anyone who commits a crime like this accountable for their actions. The federal penalties for this type of attack are severe and justified. In this instance, the local community was engaged, and their actions were essential to saving lives and led directly to Mr. Grafton's capture. It's the rest of our community's joint responsibility to step up and engage as well – don't give hate a platform to propagate and don't dismiss this type of behavior as someone else's problem, address it and immediately report suspicious activity to authorities."

According to the complaint unsealed today in White Plains federal court:

On Dec. 28, 2019, Thomas entered a Rabbi's home in Monsey, New York, which is adjacent to the Rabbi's synagogue, during observances related to the end of Shabbat and the seventh night of Hanukkah. Thomas declared to dozens of assembled congregants, "no one is leaving," and attacked the group with an 18-inch machete. At least five victims were hospitalized with serious injuries, including slash wounds, deep lacerations, a severed finger, and a skull fracture.

Following the attack, Thomas traveled in a car to New York City, and he was stopped in Harlem by members of the New York City Police Department. The responding officers observed what appeared to be blood on Thomas's hands and clothing, and smelled bleach coming from his vehicle. A search of Thomas's vehicle led to the seizure of, among other things, a machete that appeared to have traces of dried blood on it. Law enforcement subsequently searched Thomas's residence and cellphone pursuant to warrants. The residence contained handwritten journals with several pages of anti-Semitic references. Thomas's cellphone contained Internet searches dating back to at least November 2019 for terms such as "Zionist Temples" in Staten Island and New Jersey, as well as a webpage visit on the day of the attack to an article titled, "New York To Increase Police Presence After Anti-Semitic Attacks."

Thomas, 37, is charged with five counts of obstructing the free exercise of religion in an attempt to kill, in violation of Title 18, United States Code, Section 247. An indictment is merely an accusation, and the defendant is presumed innocent unless and until proven guilty. Each of the five counts carries a maximum prison term of life. The maximum potential sentence in this case is prescribed by Congress and is provided here for informational purposes only, as any sentencing of the defendant will be determined by a judge.

Assistant Attorney General Dreiband and Mr. Berman praised the outstanding efforts of the FBI, the Rockland County District Attorney's Office, the Ramapo Police Department, the Rockland County Sherriff's Office, the New York State Police, the Clarkstown Police Department, and the New York City Police Department.

This case is being handled by the Office's Terrorism and International Narcotics Unit and its White Plains Division. Assistant U.S. Attorneys Michael K. Krouse and Lindsey Keenan are in charge of the prosecution.

Maryland Attorney General News Releases Attorney General Frosh Joins Multistate Coalition Opposing Federal Efforts to Put Haitian-Born Residents at Risk of Deportation

21 Attorneys General Argue that Termination of Temporary Protected Status for Haiti Is Illegal

BALTIMORE, MD (December 30, 2019) – Maryland Attorney General Brian E. Frosh today joined a group of 21 attorneys general in challenging the Trump administration's effort to revoke Temporary Protected Status (TPS) for Haitian nationals.  If the administration is allowed to move forward, Haitian TPS holders in Maryland, other states, and the District of Columbia would lose their legal status, leaving them vulnerable to deportation.

In an amicus brief filed in support of the plaintiffs in Saget v. Trump before the United States Court of Appeals for the Second Circuit, the coalition of attorneys general argue that the administration lacked a reasonable rationale for the move, violating the Administrative Procedure Act (APA).  The brief urges the Court of Appeals to affirm the lower court's ruling and uphold a nationwide injunction against the termination to prevent widespread harm in the amici states.

Haiti first received TPS designation after the devastating earthquake of 2010.  As early as March 2017, the Trump administration set out to reverse the designation.  Political appointees in the administration pressured Department of Homeland Security (DHS) staffers to effectively manufacture a rationale for the change, pushing them to depart from established agency procedure by, for example, gathering criminality and welfare data on Haitian TPS beneficiaries.  In November 2017, Acting DHS Secretary Elaine Duke announced that the agency would terminate TPS for Haiti but her own notes revealed that she still had not established a reason for the decision.

"Haitian immigrants living under TPS in the United States are here because their home country suffered unimaginable, and long-lasting, devastation after the 2010 earthquake and other natural disasters," said Attorney General Frosh.  "Terminating their status without justification is illegal and harms states like Maryland, which has welcomed hundreds of Haitian immigrants."

In April 2019, the United States District Court for the Eastern District of New York held that DHS's decision was unlawful and ordered a nationwide preliminary injunction.  The Trump administration is now appealing the ruling in the U.S. Court of Appeals for the Second Circuit.

In the brief, the attorneys general argue that the District Court's rejection of the administration's decision should be upheld because:
  • The administration failed to justify its decision to revoke TPS for Haiti: The APA authorizes the court to declare agency actions unlawful if they are found to be "arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law."  The plaintiffs in this case submitted strong evidence indicating that DHS's decision to terminate TPS was arbitrary because it was made before Acting Secretary Duke had determined any justification.  Breaking with longstanding practice, the agency ignored the country's vulnerability to external shocks and internal instability, and buried warnings from the U.S. Embassy in Haiti that the country would not be able to reabsorb current TPS holders for "several years."
  • Ending TPS for Haiti would cause tremendous harm for tens of thousands of American families: Nine percent of Haitian TPS holders are married to U.S. citizens, and 27,000 American children have been born to these families.  Without TPS, parents in these "mixed-status" households would have to choose between returning to Haiti either with or without their children or staying in the United States under the constant fear of deportation.  These scenarios cause tremendous mental and emotional health issues, especially among children—which only intensify in the event of forcible separation.
  • Separating families creates a significant economic burden for states: For many of these "mixed-status" households, losing a family member means losing a source of income.  This could carry several consequences, including economic hardship and loss of health insurance, higher demand for social services, and homelessness.  Prior immigration enforcement actions have forced state and local governments to pay an additional $125 billion annually solely on foster care for children whose parents had been detained or deported.  These costs would increase substantially if Haitian TPS holders are forced to leave their families.
  • State economies and critical industries would suffer if Haitian residents lose TPS: Haitian nationals make significant social and economic contributions.  Over a 10-year period, revoking their legal status would cost a projected $2.7 billion in gross domestic product, over $428 million in lost Social Security and Medicare contributions, and $60 million in employer turnover costs.  Moreover, Haitian TPS holders concentrate in the hospitality, food service, education and childcare, construction, health care, and retail sectors.  Losing these workers would create labor shortages in these industries.
  • Public safety would be harmed if these residents are worried about deportation: If Haitian TPS holders lose legal status, they will be less likely to report crime, even if they are victims.  Impeding the ability of law enforcement to gather evidence of crimes will make it harder for states to enforce criminal codes.

In addition to Maryland, the brief was joined by the attorneys general of California, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maine, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Rhode Island, Vermont, Virginia, and Washington.

Woman accused of assaulting 3 Jewish women arrested again day after release

Posted: 30 Dec 2019 06:00 PM PST

A Brooklyn miscreant accused of slapping three Orthodox Jewish women last week struck again on Sunday and was busted for assaulting another woman.

A day after she was released without bail on charges stemming from the Friday attack, Tiffany Harris was charged with assault for slugging a 35-year-old in the face on Eastern Parkway near Underhill Avenue in Prospect Heights at about 9:15 a.m., according to police.

It's unclear if Sunday's victim is Jewish — and police weren't treating the incident as a hate crime. The victim suffered swelling and bruising to her right eye from the pummeling, police said.

Juan Fresnada was attacked as he walked down the street with his 29-year-old partner, Bayron Caceres, at 1.28am on Christmas Eve.

It is unclear if the attack was a homophobic hate crime, or if the assailants were simply looking to rob the pair but they took $1 from Fresnada.

He was beaten so badly that he suffered swelling to his brain and a fractured skull. Caceres was not seriously injured.

Michael Moore says Trump will WIN in 2020 because his support in Midwestern battlegrounds has not dropped 'one inch' and his followers are 'even more rabid'

Posted: 30 Dec 2019 04:30 PM PST

Filmmaker Michael Moore said that President Donald Trump had a strong chance at winning the 2020 election, claiming that his support in Midwestern battleground states hasn't dropped 'one inch.'

He added that if the presidential election were today, Trump would most likely win enough electoral college votes to clinch victory.

'If the vote were today, I believe, he would win the electoral states that he would need, because, living out there, I will tell you, his level of support has not gone down one inch,' he said in an interview with Democracy Now!

'In fact, I'd say it's even more rabid than it was before, because they're afraid now. They're afraid he could lose, because they watched his behavior. So they are voracious in their appetite for Donald Trump. That's the bad news.'

Joe Biden says he will DEFY subpoena to testify in Trump's Senate impeachment trial because it will detract attention from the president's actions

Posted: 30 Dec 2019 04:00 PM PST

Former US Vice President Joe Biden said Friday that he would not comply if subpoenaed in an impeachment trial of President Donald Trump.

Trump and fellow Republicans want to call Biden and his son, Hunter, to appear as witnesses during the proceedings for alleged corruption in Ukraine.

But speaking to the editorial board of the Des Moines Register, Biden, the current front runner for the 2020 Democratic nomination, said that compliance with a subpoena would detract from the president's own actions.

Walter E. Williams Warns Virginia About Gov. Ralph Northam’s Gun Registry Plan

Posted: 30 Dec 2019 03:30 PM PST

Columnist and George Mason economics Professor Walter E. Williams is warning Virginia residents about Gov. Ralph Northam's (D) gun registry plan.

Northam has been pushing an all-out ban on AR-15s and similar rifles for some time, but he recently changed the scope of the ban in the face of the growing Second Amendment Sanctuary movement.

On December 10, 2019, Breitbart News reported that Northam changed his position from supporting an across-the-board ban on possession of such weapons to supporting a ban only in a situation where a person refuses to register the firearm with the government. The Virginia Mercury quoted Northam spokeswoman Alena Yarmosky saying, "The governor's assault weapons ban will include a grandfather clause for individuals who already own assault weapons, with the requirement they register their weapons before the end of a designated grace period."

On December 27, 2019, Dr. Williams used a Fox News op-ed to warn Virginians "not to fall for the registration trick." He said, "Knowing who owns what weapons is the first step to confiscation."

Williams added:

James Madison, in Federalist Paper No. 46 wrote that the Constitution preserves "the advantage of being armed, which the Americans possess over the people of almost every other nation … (where) the governments are afraid to trust the people with arms."

Thomas Jefferson wrote: "What country can preserve its liberties if its rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms."

Too many Americans believe the Second Amendment grants Americans the right to own firearms only to go hunting and for self-protection. The framers of our Constitution had no such intent in mind.

The Gay Mafia Comes to Idaho

Posted: 30 Dec 2019 03:00 PM PST

A truce has been called between religious folks and gays. Or at least that's what we're being told. The Fairness for All Act, legislation intended to give rights to both Christian conservatives and transgenders, has been put before the House. For the latter, it proposes that "sexual orientation" be added to the Civil Rights Act, making it hard to discriminate against anyone on the basis of sexual identity. It gives sweeping protections in housing, business, banking, and "public accommodations." On the other hand, it grants protections to anyone in a business with fewer than 15 employees and grants exemptions to anyone in a "faith-based" organization. The Deseret News says it resulted from a dialogue between LGBT groups and representatives from the Seventh-Day Adventists, the Mormons, the Council for Christian Colleges and Universities, and other such suit-and-tie respectables.

But those of us who've escaped the wasteland-in-training known as Seattle know that the LGBT community is just that — a community. Not a uniform band of orthodox goose-steppers, but a volatile cocktail of competing doctrinaires — a hodgepodge of neatniks and weirdos, kind people and jackasses, bullies and victims. The whole gamut of men, both rotten and trustworthy. I've spent time with lots of these people, both as a coke-head and a straight-laced Christian, and I can attest that the majority are decent people. Many of them sexually looser than us, to be sure, but otherwise decent.

But alongside this decent majority stand the activist jackasses.

New York's 'Bail Reform' Is Having Detrimental Impacts, Especially on the Jewish Community

Posted: 30 Dec 2019 02:00 PM PST

New York State's new "bail reform" initiative has been thrown into the spotlight following Saturday night's stabbing attack on a Jewish congregation gathering to celebrate Hanukkah.

Beginning Jan. 1, criminals charged with most misdemeanors and Class E felonies will be released from jail without having to post cash or a bond. The goal is to not criminalize "poverty by keeping someone in jail only because they can't afford to get out," the Albany Democrat reported.

District attorneys and law enforcement officials across the state took Issue with the initiative because some misdemeanors and felonies, like theft, assault and aggravated harassment, aren't eligible for cash bail.

New York City Councilmen Chaim Deutsch and Kalman Yegar have repeatedly spoken out against the initiative, especially as anti-Semitism continues to rise.

While some Democratic 2020 candidates have expressed views that align in regards to marijuana possession, Buttigieg said that even those with class A drugs were not deserving of being locked up.

'I would not have said even five years ago what I believe now, which is that incarceration should not even be a response to drug possession,' Buttigieg told the Des Moines Register Monday.

Suspect Arrested, Drenched in Blood, in Hanukkah Machete Attack

Posted: 30 Dec 2019 09:45 AM PST

The suspect in a machete attack Saturday night in which five Jews were wounded at a Hanukkah party in Monsey, New York, has been identified as Grafton Thomas, 38.

He was arrested in Harlem by New York Police Department (NYPD) officers and "was found with blood all over his clothing and a strong smell of bleach in the car, like he was trying to destroy evidence," according to Rockland County Assistant District Attorney Michael Dugandzic.

The attack occurred at a rabbi's house in the religious community — the latest attack on Orthodox Jews near New York City. New York City Mayor Bill de Blasio has come under increasing criticism for the attacks, especially after several suspects in recent violent antisemitic attacks were released as courts have rushed to comply with the state's new "bail reform" legislation, which is supported by the de Blasio administration, and which takes full effect Jan 1.

'She loved orangutans!': Jane Fonda bemoans climate evils of palm oil-based 'vaginal lubrication'

"I'm embarrassed to admit that up until a few years ago, I didn't know anything about the evils of palm oil," the 82-year-old Fonda said in a speech at a Friday climate protest in Washington, D.C.

Referencing Grace and Frankie, the Netflix series in which she stars with actress Lily Tomlin, Fonda regaled her audience with an anecdote from the second season of the show, when her character, Grace, "very innocently" places palm oil in the homemade vaginal lubricant she planned to sell. Tomlin was arrested during Friday's protests.

Veterinarian says the Impossible Whopper ‘will make men grow breasts because of soy proteins'

Posted: 30 Dec 2019 09:15 AM PST

Amid the growing popularity of plant-based products, a doctor of veterinary medicine has suggested that the Burger King's Impossible Whopper has so much estrogen from soy that it could make men grow breasts.

In a report in Tri-State Livestock News, Dr. James Stangle of South Dakota rails against the alternative burger, made by Impossible Foods, and its use of soy protein as a main ingredient.

Strangle compares the soy-based Impossible Whopper to the beef Whopper, claiming that the plant-based version has 44 milligrams of estrogen while the original only contains 2.5 nanograms.

'Now let me refresh your metric system. There are 1 million nanograms (ng) in one milligram (mg). That means an impossible whopper has 18 million times as much estrogen as a regular whopper,' he writes.

Yale Psychiatrist Claims Pelosi Can Subject Trump to ‘Involuntary’ Mental Health Evaluation

Lee was also an editor on The Dangerous Case of Donald Trump: 27 Psychiatrists and Mental Health Experts Assess a President, and is part of a movement demanding that the Judiciary Committee bring a panel of mental health experts to join impeachment proceedings.

"As a co-worker, she has the right to have him submit to an involuntary evaluation, but she has not," Lee told Salon. "Anyone can call 911 to report someone who seems dangerous, and family members are the most typical ones to do so. But so can co-workers, and even passersby on the street."

Cuomo: Trump Is Fomenting Hate — Now We See It in Hanukkah Attack

Posted: 30 Dec 2019 08:30 AM PST

On Sunday broadcast of MSNBC's "Live," New York Governor Andrew Cuomo commented on five people being stabbed in an attack at a synagogue in New York's Rockland County.

Cuomo said, "We tend to treat these situations as isolated episodes, but really if we just connect the dots, we have a pattern of hate in this nation that is only getting worse. We've seen almost weekly attacks on people based on race, color, creed. It's hate-motivated. Apparently, there was another shooting in Texas today in a church. We've seen attacks against African-Americans, Latinos, LGBTQ community. And let's call it what it is and let government act because this can destroy this nation. It is corrosive. It's an American cancer."

He continued, "It starts at the top, and then it goes on to a point where it becomes viral across this nation. And it is now viral. And you see it coming to the surface in different manifestations from coast to coast. And we're comforted treated it as isolated episodes, but there's a pattern to all of this, and it spells hate."

Can't. Stop. Lying.

Maybe Democrats have decided that, in the era of President Trump, honesty is no longer required. Or maybe Elizabeth Warren is just too insecure to tell the truth about her own life.

Whatever the reason, the Massachusetts senator has built her campaign on a foundation of exaggerations and misrepresentations.

It's common knowledge by now that Warren, one of the top four 2020 Democratic presidential contenders, identified as a Native American, despite being somewhere between 0.1% and 3% Native American and having zero experience in tribal life. If only her misrepresentations began and ended there.

Ask her constituents in Massachusetts and they may remind you that the senator also fibbed when she promised to serve her full Senate term if reelected in 2018. Her 2020 presidential run began a few weeks after she won that election.

Warren has emphasized again and again that her children attended public schools. Her storyline here suffers from a material omission: Her kids also attended private schools. Perhaps this particular misdirection stems from the fact that she's campaigning against the school choice programs, which would give disadvantaged kids the same opportunities to pursue private education her children had.

Report: Hundreds of Michigan Election Clerks Are Unaccredited

Posted: 30 Dec 2019 07:30 AM PST

More than 500 election clerks in Michigan have not been properly accredited to run the state's elections, according to a recent audit.

"Local election clerks did not meet legal training requirements in 32 counties, 83 cities and 426 townships, a report from the office of Michigan's auditor general found," according to the Hill.

Page 19 of Auditor General Doug A. Ringler's report stated:

"We also reviewed other local election officials to determine if any election officials in those areas were fully accredited. We identified 12 counties, 38 cities, and 290 townships where the clerk had not completed the initial accreditation or continuing education training requirements and no other local election official had achieved full accreditation."

Even though the Bureau of Elections (BOE) directly assigned clerks training and continuing education through an online portal and notified them of the required training via weekly newsletters, the BOE does not have the authority to enforce participation.

"We see exactly what's happening, and we will not accept it," he said.

Scavino currently works in the White House as a presidential assistant and director of social media.

The impeachment impasse

Posted: 30 Dec 2019 06:15 AM PST

The Constitution of the United States provides in Article I that the "House of Representatives shall have the sole Power of Impeachment" and that the "Senate shall have the sole Power to try all Impeachments."

By passing articles of impeachment, the House has impeached the President. The Senate trial is being held up because House Speaker Nancy Pelosi refuses to send the articles of impeachment formally to the Senate and to name House managers to begin the process. She may withhold the articles until she is assured that the rules of a Senate trial are, in her view, fair — that they will include, among other things, an opportunity for Senate Democrats to call witnesses of their choosing and introduce documents they consider relevant to the proceedings.

However, under the Constitution, the House of Representatives has no role to play in the trial proceedings in the Senate. It cannot dictate procedures in the Senate any more than the Senate could dictate the rules of impeachment in the House. The Constitution makes it clear that the House has the "sole power of impeachment," and the Senate has the "sole power to try all impeachments." Indeed, in the Walter Nixon case (1993), the Supreme Court made it clear that not even federal courts can review Senate impeachment procedures.

WaPo exonerates 'Coonman'

Posted: 30 Dec 2019 05:00 AM PST

Message: It's always O.K. if a Democrat does it.Virginia's

Democrat governor, Ralph Northam, a.k.a., "Coonman," has been exonerated by the Washington Post's editorial page, ten months after they called on him to resign.

Back then, he was being blasted for his medical school yearbook page, which featured a photo of two figures, one wearing minstrel-like blackface getup, and the other in a full hooded Ku Klux Klan costume. We still don't know which one Northam was in that picture, he has yet to say, nor has he let us in on who his pal was, nor even told us where on earth he managed to get hold of a Klan suit.

It's now a-O.K., according to the Post's editorial page, they've issued their absolution, he's free to go about the state now, he has their imprimatur, which is kind of disgusting.

Here's the gag-inducing exoneration:
