It came as American Airlines, Delta and United suspend all flights to China for at least a month due to coronavirus fears. Frosh today joined a coalition of seven states in suing the U.S. Department of Health and Human Services (HHS) for its unlawful reinterpretation of Section 1303 of the Affordable Care Act (ACA). On December 27, 2019, HHS issued a final rule requiring qualified health plans participating in the state exchanges to separately bill for the portion of health insurance premiums attributable to abortion coverage. The rule also requires consumers to make a separate payment of at least one dollar for these services or risk losing all of their healthcare coverage. This requirement threatens women's access to abortion and puts millions at risk of losing critical health insurance coverage. "This rule is another attack by the Trump Administration on women's constitutional right to make their own health care decisions. It illegally erects barriers and increases costs for women exercising their reproductive rights," said Attorney General Frosh. "In Maryland we stand with our mothers, sisters, and daughters. We will sue to protect them." The lawsuit highlights that the new rule is incompatible with the ACA's requirement of equitable access to healthcare and disproportionately affects states, like Maryland, that are committed to ensuring comprehensive reproductive health care. All of Maryland's qualified health plans cover abortion services, and HHS itself has conceded that requiring separate bills and separate payments will inevitably lead to confusion. This puts nearly 160,000 enrollees in Maryland at risk of losing coverage if they fail to make both premium payments on time. The rule will also burden states with unnecessary administrative costs and harm consumers who could face higher insurance premiums because of increased costs to carriers. For example, initial compliance is expected to cost all impacted insurance companies nearly $400 million, with another $100 million in estimated annual costs to maintain the separate billing and payment systems. These excessive costs put pressure on insurers to remove abortion coverage from their plans and punish those Maryland insurers that cover abortion services. Victim’s Death Elevates WOC Assault Case To Homicide Posted: 31 Jan 2020 12:00 PM PST WEST OCEAN CITY- The charges against a local homeless man for the beating death of another man in West Ocean City in December were elevated from first-degree assault to first-degree murder this week after the victim succumbed to injuries sustained in the alleged attack. Eric J. Jarrett, 48, of no fixed address, on Tuesday was indicted on charges of first-degree murder, second-degree murder, first- and second-degree assault and reckless endangerment for his role in the beating death of another local homeless man at a residence on Golf Course Road in West Ocean City on December 19. Jarrett was charged immediately after the incident with first- and second-degree assault and has been held without bond since. However, the victim, identified as George L. Stinnett, 58, of no fixed address, later succumbed to injuries sustained in the alleged assault and an autopsy was ordered. When the autopsy determined Stinnett's death was a homicide, the Worcester County State's Attorney's Office then presented the new evidence to a grand jury, which indicted Jarrett this week on first- and second-degree murder and other charges. According to complaint, on May 11, 2018 around 1 p.m., local resident Scott Berry was returning from the beach and crossing Coastal Highway from east to west in the area of 36th Street in a marked crosswalk when he suffered severe burns on both of his feet. The plaintiff crossed Coastal Highway in an area that was recently repaved with fresh asphalt as part of a larger paving project. The plaintiff originally filed suit in Worcester County Circuit Court against George and Lynch, Inc., the contractor hired by the State Highway Administration (SHA) to complete the Coastal Highway paving project. The case was then moved to U.S. District Court in May 2019. The plaintiff was seeking unspecified damages in excess of $75,000, or what is essentially the jumping-off point for similar civil suits. Proposed Plan To Absorb Minimum Wage Increase Endorsed Posted: 31 Jan 2020 08:00 AM PST OCEAN CITY- The state's mandated minimum wage will continue to creep upward to $15 an hour by 2025, but the resort has a plan to absorb the financial impact. Last year, the General Assembly passed legislation mandating an incremental increase in the state's minimum wage over the next five years. As a result, the minimum wage will be increased by roughly 75-cents each year, from the $11 rate that began on January 1 to ultimately $15 by 2025. The mandated increase set pangs of fear and trepidation through local governments struggling to find a way to fund the pay increases while continuing to make ends meet, including Ocean City. On Tuesday, Human Resources Director Wayne Evans and Budget Manager Jennie Knapp outlined a plan to absorb the incremental increases without straining the budget. It scores terribly in affordability, crime, culture and wellness. The only category where it performed well was weather. In 2018, the state logged 500 violent crimes per 100,000 residents, and the state's major city, Baltimore, ranked as the third most dangerous city in the U.S. Many retirees choose not to live in Maryland due to awful winter storms, terrible road quality and painful traffic congestion. Resort Officials Sign Off On Ambitious Drone Program Posted: 31 Jan 2020 06:45 AM PST OCEAN CITY- The future has arrived in Ocean City with a plan approved this week to utilize Unmanned Aircraft Systems (UAS), or drones for all manner of public safety and other applications. For the last several months, Emergency Services Director Joe Theobald has been working with the Federal Aviation Administration (FAA) and other regulatory agencies to allow Ocean City to begin implementing a UAS, or drone, program in a variety of capacities over the skies of the resort. The use of drones for public safety and other governmental interests is certainly not new, but Theobald and his staff has been working closely with the FAA and other regulatory agencies to tailor a suitable program that meets the resort's specific needs. On Tuesday, Theobald presented the Mayor and Council with an outline of the UAS program. Rand Paul Reveals Impeachment Question Censored by Chief Justice John Roberts Posted: 31 Jan 2020 06:30 AM PST Sen. Rand Paul (R-KY) opened Thursday's impeachment trial proceedings with one of the first submitted questions for the record, but Supreme Court Chief Justice John Roberts refused to read the question to the Democrat impeachment managers and President Donald Trump's counsel. The text of the question to Rep. Adam Schiff (D-CA) and Trump's counsel, as Paul submitted it to Roberts, was subsequently obtained by Breitbart News. The text of Sen. Paul's Thursday question exactly as submitted to Roberts, the senator's office confirmed to Breitbart News, was: --Manager Schiff and Counsel for the President, are you aware that House Intelligence Committee staffer Shawn Misko had a close relationship with Eric Ciaramella when at the National Security Council together, and are you aware and how do you respond to reports that Ciaramella and Misko may have worked together to plot impeaching the President before there were formal House impeachment proceedings?" In the question, Paul does not identify Eric Ciaramella, a CIA analyst who has been widely reported to be the "whistleblower" whose complaint launched the Democrats' impeachment proceedings, as the "whistleblower." But Roberts has now multiple times throughout the trial censored any mention of Ciaramella's name, despite his direct involvement in these matters. Hillary Clinton using Secret Service to dodge defamation lawsuit, Tulsi Gabbard attorney claims Posted: 31 Jan 2020 06:00 AM PST The Secret Service blocked a server from alerting Hillary Clinton about the lawsuit filed against her by Rep. Tulsi Gabbard, according to the Hawaii congresswoman's attorney. Gabbard, 38, filed a $50 million defamation lawsuit against Clinton, 72, last week after the former secretary of state insinuated she was a "Russian asset." The lawsuit got a lot of attention, but Clinton reportedly still hasn't been served with the paperwork because she refused to let the server through Secret Service. Brian Dunne, Gabbard's attorney, told the New York Post that the person trying to serve the lawsuit was first turned away from Clinton's home in Chappaqua, New York, by Secret Service agents and told to serve the lawsuit to the former first lady's attorney, David Kendall. Williams & Connolly, the Washington, D.C.-based law firm that employs Kendall, then told the server that they could not accept the lawsuit on Clinton's behalf. "I find it rather unbelievable that Hillary Clinton is so intimidated by Tulsi Gabbard that she won't accept service of process," Dunne said. "But I guess here we are." Impeachment manager Hakeem Jeffries (D-NY) on Thursday was asked whether the Clinton campaign's use of the Steele Dossier in 2016 would be considered impeachable under the Dems' standard.
