A Message from Ocean City Mayor Meehan - Save Our Sunrise

Posted: 16 Jan 2020 09:00 PM PST

Dear Ocean City Residents, Property Owners, Visitors & Friends,

Our 10 mile, beautifully maintained beach and three-mile historic Boardwalk often rank among the nation's top beaches, offering families like yours the perfect place to relax and enjoy the naturally beautiful view of the Atlantic Ocean. Unfortunately, our natural viewshed is in danger of being lost forever.

As you may or may not know, two companies are planning to build offshore wind farms directly off of Delaware and Maryland beaches. An Italian company (U.S. Wind) plans to construct dozens of 853-foot-tall wind turbines, located on 46,595 acres (73 square miles) of Atlantic Ocean, as close as thirteen miles from our beloved beach. This project will forever change the natural beauty of our beach, not only for us but for future generations.

The Town of Ocean City while in support for clean energy in Maryland; has opposed the size and location of the wind turbines. In order to avoid the destruction of our natural view forever and the negative impact on our community, the Town of Ocean City is insisting these turbines be moved at least 33 miles from shore. This distance would allow the project to continue without having any impact on our natural horizon, our tourism, our home values, our economy and future generations. This can be done. In fact, the State of Virginia recently approved a project 27 miles off their coast.

A public hearing will be held on Saturday, January 18, 2020 at 12 p.m. at the Roland E. Powell Convention Center (4001 Coastal Highway, Ocean City, Maryland). As residents, property owners, visitors and protectors of the future of Ocean City, we need your voice of concern at the Public Service Commission.

We have said it before, and we will say it again…. We only have one chance to do this, so we need to do it right. Making sure these turbines are out of the viewshed of Ocean City is not only a benefit to our residents and property owners, but also to the 8 million people who visit our beach each year. Most importantly, it is our responsibility to protect the natural beauty of our beach so that our children, grandchildren and their grandchildren can enjoy the same pristine horizon that we enjoy every day in Ocean City.

Sincerely,

Mayor Rick Meehan

Town of Ocean City, Maryland

29 criminal aliens released by Franklin County Sheriff's Office in recent weeks

Posted: 16 Jan 2020 07:30 PM PST

COLUMBUS — The Franklin County Sheriff's Office has released 29 criminal aliens and immigration violators since November 2019, despite written detainer requests filed with them by U.S. Immigration and Customs Enforcement (ICE).
"When dangerous criminal aliens are released into the community, public safety is needlessly put at risk because of the individual's propensity to re-offend," said Rebecca Adducci, field office director for ICE's Enforcement and Removal Operations (ERO) in Michigan and Ohio. "ICE remains committed to arresting and removing criminal aliens in the interest of public safety and national security, despite local decisions to not honor detainers and jeopardize the safety of its citizens."
ICE recently apprehended the following criminal alien after his release from the Franklin County Sherriff's Office with an active detainer in place:
  • Hajir Muhammud, a 59-year old national of Somalia, was arrested by local authorities Dec. 27, for failure to register as a Tier 1 sex offender. He is a convicted sex offender for crimes involving children. ICE lodged a detainer following his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. On Jan. 6, ICE arrested Muhammud, and he is currently in custody pending removal proceedings.
However, several criminal aliens released by the Franklin County Sheriff's Office are currently at-large. Efforts by ICE to apprehend these men are currently underway. They include:

  • Edgar Moreno-Soto, a 25-year-old Mexican national, was arrested Nov. 6, for felony firearm charges, drugs, among other charges. ICE lodged a detainer after his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. His current location is unknown.
  • Manuel Vazquez-Sanchez, a 25-year-old Mexican national, was arrested Nov. 8, for domestic violence, assault, falsification and menacing. He has been removed from the U.S. twice since 2018 ICE lodged a detainer after his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. His current location is unknown.
  • Arturo Maya-Sanchez, a 28-year-old Mexican national, was arrested Nov. 9, for domestic violence, DUI and domestic violence. He has been removed from the U.S. twice since 2018. ICE lodged a detainer after his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. His current location is unknown.
  • Marvin Fabricio Herdnandez-Chicas, a 24-year-old Salvadoran national, was arrested Nov. 3, for domestic violence and assault. ICE lodged a detainer after his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. His current location is unknown.
  • Martin Antonio Paredes-Zamorano, aka Wilfred Vega, a 31-year-old Mexican national, was arrested Dec. 15, for DUI and having a loaded firearm in his vehicle. He was previously removed from the U.S. in 2014. ICE lodged a detainer following his arrest. He was subsequently released after Franklin County declined to honor the ICE detainer. His current location is unknown.
If you have any information on the above at-large individuals, please call the ICE tip line at 1-866-DHS-2-ICE (866-347-2423).

About Detainers

ICE lodges detainers on individuals who have been arrested on criminal charges and who ICE has probable cause to believe are removable aliens.  The detainer asks the other law enforcement agency to notify ICE in advance of release and to maintain custody of the alien for a brief period of time so that ICE can take custody of that person in a safe and secure setting upon release from that agency's custody.
When law enforcement agencies fail to honor immigration detainers and release serious criminal offenders onto the streets, it undermines ICE's ability to protect public safety and carry out its mission. This negatively impacts public safety and ICE's efficiency in the apprehension of criminal aliens. Federal immigration laws authorize DHS to issue detainers and provide ICE broad authority to detain removable aliens.
Congress has established no process, requirement, or expectation directing ICE to seek a judicial warrant from already overburdened federal courts before taking custody of an alien on civil immigration violations. This idea is simply a figment created by those who wish to undermine immigration enforcement and excuse the ill-conceived practices of sanctuary jurisdictions that put politics before public safety.

Sanctuary Policies Put Public Safety at Risk

  • When law enforcement agencies don't honor ICE detainers, these individuals, who often have significant criminal histories, are released onto the street, presenting a potential public safety threat.
  • Any local jurisdiction thinking that refusing to cooperate with ICE will result in a decrease in local immigration enforcement is mistaken. Local jurisdictions that choose to not cooperate with ICE are likely to see an increase in ICE enforcement activity, as the agency has no choice but to conduct more at-large arrest operations. A consequence of ICE being forced to make more arrests on the streets, the agency is likely to encounter other unlawfully present foreign nationals who would not have been encountered had we been allowed to take custody of a criminal target within the confines of a local jail.
  • Additionally, once these criminals are out on the street, confirming their whereabouts is often time consuming and resource intensive. Many of our arrest targets are seasoned criminals who are savvy about eluding law enforcement.

What is an Atmos Clock?

Imagine a device you use every day, whether that's a remote control, an electric toothbrush or your smartphone.

Now imagine you never had to change or charge up the batteries. How freeing would that be?

Our toothbrushes would never fizzle out, our smartphones would never hit 0 percent and that beeping from the smoke detector would stop.

In the watch world, we think of watches without batteries simply as automatics. They wind by movement from your wrist and arm throughout the day. The Atmos clock, however, doesn't need movement from a human and surely doesn't require a battery.

‘Fist Bumps And High Fives’: Kellyanne Conway Blasts Pelosi For ‘Embarrassing’ Impeachment Souvenir Pens

Posted: 16 Jan 2020 06:30 PM PST

White House counselor Kellyanne Conway blasted House Speaker Nancy Pelosi Thursday over the "embarrassing" pens used to sign the articles of impeachment.

Pelosi faced criticism after handing out souvenir impeachment signing pens Wednesday. The moment came during the transmission of the articles of impeachment.

"It was historic but for a different reason," Conway said Thursday on Fox News. "Nancy Pelosi's fist bumps and high fives and commemorative pens. It was embarrassing. It was anything but solemn and bipartisan. I think that she really screwed up this process from the beginning."

OCPD Reports Drop In Applicants For 2020 Season

Posted: 16 Jan 2020 05:30 PM PST

OCEAN CITY – As the Ocean City Police Department prepares for the upcoming summer season, Police Chief Ross Buzzuro shared his recruitment concerns this week.

On Monday, Buzzuro presented the Ocean City Police Commission with an update on recruitment efforts for seasonal officers and public safety aides.

"We have seen a dropoff in candidates," he said, "about 40% on the seasonal officer [side] and about 30% on the public safety [side]."

As of the first January testing date in 2020, 62 candidates had applied for seasonal police officer positions. At the same time last year, the number of candidates exceeded 100.

Buzzuro told the commission the department had 32 seasonal officers returning for the 2020 summer season. But he said the number of applicants for the seasonal program had decreased in the last five years.

*Update* Troopers Arrest Suspect in String of Church Burglaries – Sussex County

Posted: 16 Jan 2020 04:30 PM PST

Sussex County- The Delaware State Police have arrested 31-year-old Adam M. Calloway in connection with recent multiple church burglaries in Sussex County.
In the beginning of January 2020, the Delaware State Police began investigating burglaries to various churches in the Laurel, Seaford, Millsboro and Georgetown areas including the following:
  • Carey's United Methodist Church located at 22053 Careys Camp Road, Millsboro which occurred on January 11, 2020, during the overnight hours.
  • Saint Johns AME Church located at 31034 East Trap Pond Road, Laurel which occurred between January 8 and January 11, 2020.
  • Trinity Church located at 17237 Phillips Hill Road, Millsboro which occurred between January 6 and January 11, 2020.
  • Iglesai Evangelica Betana Church located at 22143 Coverdale Road, Seaford which occurred between January 6 and January 12, 2020.
  • Mt. Olivet Church located at 28096 Shortly Road, Georgetown which occurred between January 11 and January 12, 2020.
It was learned that in all of these incidents, the point of entry was an exterior window in which the suspect used force to break the glass.  Through further investigations, Adam Calloway was identified as the suspect.
On January 15, 2020, Troopers responded to the Sunrise Motel located at 22512 Sussex Highway, Seaford, where Calloway was located. Upon contact with Calloway in the motel room, Troopers observed crack cocaine in plain view and a .22 caliber bullet.  Calloway was taken into custody and as he was being escorted outside of the motel room to the patrol vehicle, he proceeded to resist arrest and flee on foot. Calloway was subsequently apprehended a short time later.
Detectives obtained a search warrant for the motel room in which Calloway was staying.  Upon the execution of the search warrant, Detectives located numerous amounts of what was believed to be stolen property and seized the items. It was later learned that during the overnight hours of January 14, 2020, Troopers responded to an address in the 26000 block of Butler Branch Road, Seaford, in reference to a burglary complaint.  Detectives recovered items in the motel room belonging to the victim. Calloway was subsequently identified as the suspect in this residential burglary incident as well as another residential burglary that occurred on January 4, 2020 at a residence in the 24000 block of Concord Pond Road, Seaford.
Calloway was transported back to Troop 4 where he was charged with the following:
  • Burglary Second Degree (2 counts)
  • Attempted to Commit Burglary Third Degree (2 counts)
  • Burglary Third Degree (3 counts)
  • Theft (Felony) (2 counts)
  • Attempted to Commit Theft (2 counts)
  • Theft Under $1500
  • Criminal Mischief (4 counts)
  • Possession of a Firearm or Ammunition by a Person Prohibited
  • Resisting Arrest
  • Possession of a Controlled Substance
Calloway also had 13 active arrest warrants out of various agencies in Delaware.
Calloway was arraigned before the Justice of the Peace Court and committed to the Sussex Correctional Institution on $29,507.00 secured and $11,200.00 cash only bond.
The investigation continues to remain active and ongoing with further charges pending.

Attorney General Frosh Joins Multistate Lawsuit to Stop Elimination of Food Assistance for Nearly 700,000 Struggling Americans

Posted: 16 Jan 2020 03:30 PM PST

15 Attorneys General and New York City Allege the USDA Attempted to Circumvent Congress with Unlawful Food Stamp Rule Change

BALTIMORE, MD (January 16, 2020) – Maryland Attorney General Brian E. Frosh today joined a group of 15 attorneys general and New York City in a lawsuit to stop the Trump administration from eliminating food assistance for nearly 700,000 Americans.  The lawsuit challenges a United States Department of Agriculture (USDA) rule that would limit states' ability to extend benefits from the Supplemental Nutrition Assistance Program (SNAP), commonly known as "food stamps," beyond a three-month period for certain adults.

The coalition of attorneys general asserts that the rule directly undermines Congress' intent for SNAP, and that the USDA violated the federal rulemaking process.  Further, they argue that the rule would impose significant regulatory burdens on the states and harm states' residents and economies.  The coalition is urging the court to declare the rule unlawful and issue an injunction to prevent it from taking effect.

"SNAP is the country's most important anti-hunger program; it lifts people out of poverty and food insecurity This rule will cause Marylanders to go hungry.  It is unnecessary and heartless," said Attorney General Frosh.

SNAP has served as the country's primary response to hunger since 1977, and is a critical part of federal and state efforts to help lift people out of poverty.  The program provides access to nutrition for millions of Americans with limited incomes who would otherwise struggle with food insecurity.  While the federal government pays the full cost of SNAP benefits, it shares the costs of administering the program on a 50-50 basis with the states, which operate the program.

Congress amended SNAP in 1996 with the goal of encouraging greater workforce participation among beneficiaries.  The changes introduced a three-month time limit on SNAP benefits for unemployed individuals aged 18 to 49 who are not disabled or raising children (i.e., "able-bodied adults without dependents" (ABAWDs)).  Congress understood that states were best positioned to assess whether local economic conditions and labor markets provided ABAWDs reasonable employment opportunities.  As a result, the law allows a state to acquire a waiver of the ABAWD time limit for areas where the unemployment rate is above 10 percent, or if it presents data demonstrating that the area lacks sufficient jobs for ABAWDs.  States also were given a limited number of one-month exemptions for individuals who would otherwise lose benefits under the time limit and were permitted to carry over unused exemptions to safeguard against sudden economic downturns.

Over the last 24 years, Congress has maintained the criteria for states to obtain waivers and to carry over unused exemptions.  It has reauthorized the statute four times without limiting states' discretion over these matters.  House Republicans considered adding restrictions on waivers and carryovers in the 2018 Farm Bill, but a bipartisan coalition expressly rejected them in the final legislation.

Shortly after President Trump signed the 2018 Farm Bill into law, USDA announced a proposed rule seeking changes almost identical to those Congress rejected.  USDA received more than 100,000 comments in total—the majority of which reflected strong opposition from a broad range of stakeholders.  Regardless, USDA's final rule went even further in restricting state discretion over waivers and exemptions than what it had initially proposed.

In the lawsuit, the states collectively argue that the administration's rule:
  • Contradicts statutory language and Congress's intent for the food-stamp program: When Congress amended SNAP and added the ABAWD time limit in 1996, it included a waiver process explicitly providing for relief from the time limit if insufficient job opportunities were available for ABAWDs and clearly indicating that states were best equipped to make this determination based on local economic and employment conditions.  Congress has reaffirmed this position multiple times, most recently in 2018.  Yet USDA's new rule severely restricts states' discretion over these matters and essentially writes this basis for waiver out of the statute, contrary to law and congressional intent.  Major aspects of the rule mirror proposed changes that Congress explicitly rejected in 2018.
  • Raises healthcare and homelessness costs while lowering economic activity in the states: For SNAP recipients, losing benefits means losing critical access to food, raising the risk of malnutrition and other negative health effects.  Studies have shown that SNAP can counteract food insecurity and lower healthcare costs for recipients by about $1,400 per person—costs that state governments will likely bear in the absence of SNAP assistance.  Without SNAP benefits, many will be forced to choose between having food to eat or a place to live.  Their purchasing power will decrease, harming state economies.  As USDA concedes in the rule, these impacts will be most concentrated among lower-income communities of color
  • Amends the law for arbitrary and capricious reasons: The APA requires agencies to offer a reasoned explanation for changing long-held policies and address why the facts and circumstances supporting the prior policy should be disregarded.  For over two decades, USDA has accepted Congress's premise that a state should define the geographic scope of its waiver request and support that request with a wide range of data sources that are together best able to capture employment prospects for ABAWDs.  Yet the new rule strictly defines the area for which waivers may be sought and rejects data beyond general unemployment figures without any justification.
  • Violates the federal rulemaking process: The Administrative Procedure Act (APA) governs internal procedures for federal agencies, including rulemaking.  Among other requirements, agencies must solicit and consider public comments on the substance of a rule.  USDA broke from this process by issuing a final rule that diverged from its proposed rule in significant ways.  For example, while the proposed rule maintained that a state could receive a waiver if it qualified for extended unemployment benefits under Department of Labor policies, the final rule eliminated this basis.  Thus, commenters did not receive meaningful opportunity to comment on the full extent of the agency's changes.
The lawsuit was filed in United States District Court for the District of Columbia.  The States filed a Motion for Preliminary Injunction concurrently with the complaint to prevent the rule from going into effect on April 1, 2020.
Joining Maryland in the lawsuit are the attorneys general of California, Connecticut, the District of Columbia, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont, and Virginia, along with the City of New York.

SALISBURY – The school board voted this week to approve an amended calendar for the 2020-2021 academic year after receiving more than 1,600 responses from the community.

On Tuesday, the Wicomico County Board of Education approved on second reading a 2020-2021 school calendar for that will begin the academic year on Sept. 8 and end the academic year on June 15.

"We are presenting a calendar for consideration and second reading," Kim Miles, assistant superintendent for student and family services, told the board this week. "This calendar takes into account the feedback, which we were extremely excited about."

Pocomoke City Council Under Fire Again

Posted: 16 Jan 2020 02:30 PM PST

A small Eastern Shore town that fired its first Black police chief amid allegations of racism is under fire again after hiring a new city manager from a nearby community, who was also embroiled in a scandal involving policing and race.

The Pocomoke City Council approved the appointment of Jeanette DeLude as the town's new city manager last week. She takes over a city now under a federal consent decree, which requires the town to address a history of discrimination and retaliation against African American employees, through new policy and reform.

The hiring comes shortly after the city settled a federal discrimination lawsuit brought by its former Police Chief Kelvin Sewell, who was fired by the council in 2015 without explanation. The settlement includes a consent decree which require the city to implement new policies to handle discrimination claims.

"I Think You Just Called Me A Liar": Ex-Native-American Liz Warren Snaps At Bernie On Hot Mic

Posted: 16 Jan 2020 01:30 PM PST

Having spent most of her political life lying about her heritage, Senator Elizabeth Warren dropped the liar-liar-pants-on-fire hammer on Senator Bernie Sanders last night in what was by far the most entertaining - albeit brief - part of the entire night's Democratic debate.

CNN has released the audio to go with the most awkward viral moment following the debate on stage where Warren refused to shake hands with Sanders.

CNN reports that the conversation was not captured on the primary audio feed from the candidates' podiums. After the debate, CNN did an inventory of the audio equipment that was used and found two backup recordings from the microphones Sanders and Warren were wearing.

CNN then synchronized the audio recordings with the footage that was broadcast live on Tuesday night.

The conversation played out on the debate stage, in public view, and occurred before Sanders and Warren's clip-on microphones were removed.

NOTICE OF INVESTIGATION

Michael Avenatti is ARRESTED by Feds for 'bail violations' during disciplinary hearing with California's State Bar Court ahead of his extortion trial

Posted: 16 Jan 2020 01:00 PM PST

California attorney Michael Avenatti has been rearrested for alleged bail violations, prosecutors in New York told a judge late Tuesday.

The prosecutors said in a one-page letter to U.S. District Judge Paul G. Gardephe that they were told by prosecutors in Los Angeles that an arrest warrant had been issued and it was expected Avenatti would be arrested soon.

'We understand that has now occurred,' the New York prosecutors said in the letter.

'We are still gathering information and will provide an update to the Court as soon as we can,' the letter added.

#RedforEd Teachers Step Up 2020 Political Engagement in Florida

Posted: 16 Jan 2020 12:30 PM PST

The #RedforEd teachers' movement continued to step up its 2020 political engagement with a rally Monday afternoon in Tallahassee, the capital of the battleground state of Florida.

Though it was an official school day for public schools in Florida, a crowd of several thousand teachers and supporters, most wearing the movement's trademark red t-shirts, rallied to "Take on Tallahassee" where they highlighted their demands for more pay and more school funding to the Florida State Legislature, which returns to session on Tuesday.

Last week in Minnesota, "The #RedforEd teachers' movement confirmed it is a purely political movement designed to help elect Democrats and stop the re-election of President Donald Trump in 2020.

Governor Hogan Announces More Than $1 Billion in Tax Relief for Maryland Retirees

Posted: 16 Jan 2020 12:00 PM PST

Biggest Tax Reduction in Maryland in More Than Two Decades
Retirees with Maryland Income Up to $50,000 Would Pay No State Income Tax Whatsoever
Next Step in Fulfilling Commitment to Eliminate All Retirement Taxes in Maryland

ANNAPOLIS, MD—Governor Larry Hogan today announced a more than $1 billion tax relief proposal to make it more affordable for retirees to stay in Maryland. This legislation, which would lower taxes for more than 230,000 Marylanders, is the biggest tax reduction in Maryland in more than two decades.

"People who have been lifelong Marylanders and have contributed so much, and still have more to offer, are moving to other states for one reason—our state's sky-high retirement taxes," said Governor Hogan. "When I first ran for governor, I said that once we solved the budget crisis and turned our economy around I wanted to eventually reach the point where we could eliminate all retirement taxes just as other states have done. That is still our goal, and this tax cut is a major step toward achieving it."

The Retirement Tax Reduction Act of 2020 will cut retirement taxes for Marylanders by more than $1 billion over five years. This legislation will eliminate all state tax on the first $50,000 of income for retirees making up to $100,000 in federally adjusted gross income. Retirees with Maryland income up to $50,000 will pay no state tax whatsoever in the state of Maryland. This tax reduction will be phased in over five years, beginning in FY22.

"This legislation will provide tax relief to 230,000 Marylanders, is the largest tax reduction in Maryland in more than two decades, and it will keep tens of thousands of Maryland retirees from being forced to flee our state," the governor continued. "As long as I am governor, I will continue to fight to make it easier for Maryland families, small businesses, and retirees to stay in our state, and to make it easier for all Marylanders to keep more of their hard-earned money."

Over the last five years, Governor Hogan has led an historic economic turnaround, with the state going from losing 100,000 jobs prior to taking office to gaining 140,000 jobs. More businesses are open and more people are working than ever before in the history of the state. The governor has already delivered $1.25 billion in tax, toll, and fee relief for hardworking families, retirees, and small businesses.

Despite this progress, a recent survey found that Maryland is the worst state for retirees, ranking near the bottom in affordability. Since taking office, Governor Hogan has taken numerous steps to fulfill his commitment to eliminate state income taxes on all retirement income.

In addition to today's announcement, the governor has introduced the Hometown Heroes Act of 2020 to exempt law enforcement, fire, rescue, corrections, and emergency response personnel from state tax on all retirement income specific to their service in those professions. This is the fifth year that Governor Hogan has introduced legislation to eliminate state taxes on the retirement income of first responders. In 2017, the governor was proud to enact the Hometown Heroes benefit so that first responders can exempt the first $15,000 of their retirement income from state taxes. This year, he is again pushing to fully exempt all retirement income for these occupations and to lower the age of eligibility from 55 to 50.

The governor has also announced legislation to eliminate all state taxes on retirement income received as a result of military service. In 2015, the governor enacted legislation to increase the tax exemption on military retiree pensions from $5,000 to $10,000 for retirees 65 years or older, and in 2018, he again enacted legislation that increased the exemption by 50% to $15,000 and lowered the eligibility age to 55.

Physician Burnout Widespread

Posted: 16 Jan 2020 11:30 AM PST

Physicians between the ages of 40 and 54 experience a higher rate of burnout than younger or older physicians, according to a recent survey of more than 15,000 physicians who cited administrative tasks and work hours as key drivers of their stress.

Nearly half of Generation X physicians reported feeling burned out, compared with 38% of millennials, ages 25 to 39, and 39% of baby boomers, ages 55 to 73, surveyed. Roughly half of all the doctors surveyed also said that they would be willing to take a substantial pay cut to achieve a better work-life balance.

Some 55% of physicians reported that administrative tasks as the main driver of burnout, and spending too many hours at work was also a top contributor across the board. But millennial and Gen X doctors cited also a lack of respect from administrators, employers or colleagues as a top concern, while boomers highlighted increased computerization and electronic medical records.

Gen. Michael Flynn Moves to Withdraw Guilty Plea

Posted: 16 Jan 2020 11:00 AM PST

Former Trump National Security Advisor and retired Army Lt. Gen. Michael Flynn filed a motion Tuesday to withdraw his guilty plea as part of a plea deal in the Russia inquiry, according to his lawyer Sidney Powell.

She tweeted:

"We just filed a Motion to Withdraw the plea of @GenFlynn because the government acted in bad faith, with vindictiveness, and breached the plea agreement pursuant to which he has cooperated fully at great personal expense and "held back nothing" according to #prosecuters until @GenFlynn refused to LIE on demand from #prosecutors in EDVA in Rafiekian case."

Powell also said in a statement sent to OANN's Jack Posobiec:

"Gen. Flynn is innocent of all charges, the government's allegations are false, and evidence the government released only recently needs to be reviewed and addressed. Mr. Flynn was always truthful, and future filings will make that clear. Gen. Flynn has been targeted by vindictive and unprincipled prosecutors."

She argued that Flynn upheld his end of the plea deal in being truthful, but the government did not uphold its end and tried to coerce Flynn to lie.

WaPo, NYT Aiding China’s Global Propaganda Efforts, Watchdog Warns

Posted: 16 Jan 2020 10:30 AM PST

America's "leading newspapers" are aiding China's communist regime by running the oppressive government's propaganda, respected watchdog organization Freedom House reported.

The Washington Post, Wall Street Journal and New York Times have all run paid supplements from China Daily, the Chinese government's state media arm. The paid supplements, dubbed "China Watch," are designed to look like real news articles.

The paid supplements are a way in which Chinese state media "exploit foreign media outlets," Freedom House warned in its report, "Beijing's Global Megaphone."

"In the case of the Washington Post and some other publications, China Watch also appears as an online feature, further blurring the lines between Chinese state media content and the host outlet's own reporting," the report noted.

The Daily Caller News Foundation reached out to all three newspapers to ask if they would commit to cease running the paid supplements, given the Chinese regime's persecution of ethnic and religious minorities, and whether they would disclose how much revenue they received from the Chinese advertisements.

New Hampshire bill would limit women's sports participation to biological females

Posted: 16 Jan 2020 09:45 AM PST

A bill proposed in the New Hampshire statehouse would limit participation in women's sports to only biological females and has sparked accusations of discrimination from advocates for transgender rights in the state.

"I am a commonsense mom and a woman, and I don't have to put quote marks around it," Victoria Galla said during a public hearing on House Bill 1251, according to the Union-Leader. "When I hear people put quote marks around it, that is insulting to me as a woman. If you are endorsing transgender kids, you are endorsing child abuse."

Proponents of the bill argued allowing biological males to compete in womens sports is unfair and takes spots on school teams away from women.

Wisconsin Court Temporarily Blocks Purge of Up to 209,000 Names From Voter Rolls

Posted: 16 Jan 2020 09:30 AM PST

A Wisconsin appeals court ordered the state on Jan. 14 to temporarily halt the removal of more than 200,000 people from its voter registration rolls for failing to answer questions about their addresses.

The removal of as many as 209,000 names was put on hold a day after an Ozaukee County judge found three members of the Wisconsin Elections Commission in contempt of court for ignoring an order he gave in December 2019.

An appeals court judge also blocked the contempt finding in a separate order, putting on hold a decision that fined the three Democratic members $250 a day each until they voted to purge the names.

The appeals court on Jan. 14 ordered that the lower court's order against the commissioners and a Dec. 13 order to purge the names from voter rolls be "stayed until further order of this court," the court clerk wrote.

Fact Check: No CNN, Trump Does Not Want to Cancel Coverage for Pre-Existing Conditions

Posted: 16 Jan 2020 09:15 AM PST

CLAIM: President Donald Trump wants to cancel health insurance coverage for people with pre-existing conditions.

VERDICT: False. Trump supports repealing Obamacare but has always backed coverage for pre-existing conditions.

CNN moderator Abby Phillip stated several false or contested claims as facts at the Democrat debate on Tuesday night.

One was the claim that President Trump wants to end health insurance coverage for pre-existing conditions, simply because the president also supports a court challenge to Obamacare. In fact, while repealing the individual mandate of Obamacare, and backing a full "repeal and replace," Trump has always insisted on covering people with pre-existing health conditions.

New Evidence In Michael Flynn Case Shows Government Prosecutors Pushed Him To Lie

Posted: 16 Jan 2020 09:00 AM PST

Michael Flynn's attorney, Sidney Powell, has filed a Motion to Withdraw his Guilty Plea, arguing the government breached its obligations under the plea agreement the retired general had entered with the special counsel's office in late 2017. Prosecutors had promised in that plea agreement to "file a departure motion pursuant to Section 5K1.1 of the Sentencing Guidelines" if Flynn provided substantial assistance to the government.

The government kept that pledge—until it didn't.

On December 4, 2018, prosecutors working for the special counsel's office filed a Memorandum in Aid of Sentencing, stating that the government has moved for a downward departure pursuant to Section 5K1.1, to reflect Flynn's "substantial assistance to the government."

Section 5K1.1 authorizes a judge to depart from the sentencing guideline—a set of standards used to assess an appropriate sentencing range for a defendant—if the government files a motion "stating that the defendant has provided substantial assistance in the investigation or prosecution of another person who has committed an offense . . ." A court cannot depart from the guidelines under Section 5K1.1, unless the prosecution files such a motion.

The government re-iterated its position on December 18, 2018, at Flynn's originally scheduled sentencing hearing. "Mr. Flynn should receive probation," prosecutors said, with lawyer Brandon Van Grack, who represented the special counsel's office, "thoroughly prais[ing] Mr. Flynn, telling the court: 'I'd like to highlight that General Flynn has held nothing back, nothing in his extensive cooperation with the Special Counsel's Office. He's answered every question that's been asked. I believe they feel that he's answered them truthfully, and he has. He's complied with every request that's been made, as has his counsel. Nothing has been held back."

The Biggest Loser of Tuesday's Dem Debate Wasn't Any of the Candidates

Posted: 16 Jan 2020 08:30 AM PST

CNN's bias was in full force Tuesday evening during the seventh Democratic debate, particularly in the way the moderators clearly favored Sen. Elizabeth Warren over Sen. Bernie Sanders.

Moderator Abby Phillip asked Sanders about the private meeting he had with Warren in which he allegedly told her (according to the network's reporting) that he didn't think a woman could win the election.

The Vermont senator said the idea he would believe that is "incomprehensible" and pointed to footage of him from 30 years ago talking about how a woman could become president of the United States.

Gun advocates see ‘registry’ and ‘confiscation’ coming to Virginia

Posted: 16 Jan 2020 07:30 AM PST

Despite the expansion of "gun sanctuaries" to a record 130 Virginia towns and counties Wednesday, covering most of the state, foes of gun control legislation speeding through Richmond are raising new fears they will be forced to register weapons, a move that could lead to "confiscation."

Second Amendment lobbyists and advocates reviewing the initial gun control moves by a state Senate committee credit the exploding sanctuary movement for forcing Democrats to accept some compromises, including a less strict universal background check and delay in introducing a ban on "assault weapons."

But they are concerned that even watered down gun control legislation will eventually lead to broader restrictions and bans.

Trump says he will try to attend July 4 fireworks at Mount Rushmore

President Trump said he would try to visit Mount Rushmore on the Fourth of July to watch the planned fireworks.

"I called up our people and in 15 minutes got it approved, and we will have the first fireworks display at Mount Rushmore, and I will try and get out there if I can," Trump said Wednesday.

Trump has brushed off environmental concerns about the fireworks display at the South Dakota landmark, which has not had fireworks since 2009 when they were discontinued over concerns related to the pine beetle infestation in the Black Hills National Forest.

Blackburn: Four Senate Dems vying for president should recuse from impeachment trial

Posted: 16 Jan 2020 06:30 AM PST

Sen. Marsha Blackburn has suggested her Democrat colleagues running for president should be recused from sitting as jurors in the impeachment trial against President Trump.

"Tomorrow, one hundred United States Senators will be sworn in to serve in the impeachment trial of President Donald Trump. Four of those Senators must recuse themselves for their unparalleled political interest in seeing this President removed from office," said the Tennessee Republican.

Ms. Blackburn is referring to Sen. Bernie Sanders, Vermont Independent, Sen. Elizabeth Warren, Massachusetts Democrat, Sen. Michael Bennet, Colorado Democrat, and Sen. Amy Klobuchar, Minnesota Democrat.

"To participate in this trial would be a failure of the oath they took to be an 'impartial justice according to the Constitution and laws'. Their presidential ambitions prohibit their ability to view this trial through an objective lens," Ms. Blackburn said.

Supreme Court chief asks if ‘OK, boomer’ qualifies as workplace age discrimination

Posted: 16 Jan 2020 06:15 AM PST

Chief Justice John Roberts questioned whether using the phrase "OK, boomer" would qualify as age discrimination.

On Wednesday, the court heard oral arguments for the case of Norris Babb, a Department of Veterans Affairs employee who says she was fired because of her age and gender. Babb sued the department because she was one of four women over the age of 50 to be denied a high-paying position on an innovative patient care program in Florida in 2010. She claimed that less qualified, younger female pharmacists were appointed to the team, as were older male doctors.

Babb's attorneys claim that her age was a "motivating factor" in the decision not to promote her to the program. The department argued the law says that discrimination occurred if the individual would have gotten the job "but for" his or her age. The latter argument creates a much higher standard of evidence because the individual must prove that age was the only factor for being refused a position.

Breaking: West Virginia Lawmakers Invite Persecuted Pro-Second Amendment Counties in Virginia to Join Their State

Posted: 16 Jan 2020 06:00 AM PST

West Virginia lawmakers introduced legislation to invite persecuted pro Second Amendment Counties to join their state.

The West Virginia Senate adopted a resolution to remind Virginia residents from Frederick County that they have a standing invite — from 1862 — to become part of West Virginia.

West Virginia freedom fighters broke away from Virginia Democrat slave owners during the Civil War.

This week West Virginia has once again invited persecuted Virginia pro 2-A counties to come join their state.

Sounds like a winning plan!

Two Wrongs Don't Make A Right: You CANNOT euthanize your way out of this problem.

Posted: 16 Jan 2020 07:11 AM PST

Well I certainly got everyone's attention yesterday about the cat issue that's going on within the city of Salisbury. You have the equivalent of an uneducated animal control staff that is trapping cats that have already been neutered and vaccinated and are being trapped because a property owner or tenant doesn't want the cat trespassing on their property. You now as a city resident have to control the movement of your outside cat which any kindergartner knows isn't possible, practical, or probable in the cat world.

So now these under-educated dog catchers are appeasing one individual temporarily, while unwittingly creating a vacuum for another unvaccinated, non-neutered cat to takes its place.

Just like euthanizing the goose problem didn't go away or scare the new geese away that are now free to populate the void that was left after wasting tax dollars to kill 400 geese. No one told the new geese about their predecessors, so the geese keep coming to the city to set up their new home.

Exactly what happens when you remove feral cats. You CANNOT euthanize your way out of this problem.

What needs to happen is these groups: animal control officers, the Humane Society, and any organization that is helping these local cats need to get together and work out a sensible plan of action.

Perhaps animal control can educate the folks that seem to have no tolerance for an abandoned animal that never asked to be in the middle of this mess.

And maybe the Humane Society can refuse to allow any TNR cat to be brought into the shelter simply because it's an inconvenience for someone else. And if an individual purposely traps a cat in foul weather and makes them sick they should be charged with animal cruelty. And lastly the folks who tirelessly provide this TNR service to an adjoining county should be praised and thanked for their unconditional work. They don't get any funding for what they do. They aren't paid a salary, and they constantly reach into their own pockets  to clean up the mess that irresponsible adults make with a pet they choose to own. Only abandon them and create the problem in the first place.

Anyone who complains about this should be sending in donations to groups like Community Cat Coalition that can't even afford to pay for the repairs needed to their dilapidated van. After all, without their help the feral cat problem you have now just might end up exploding into thousands of cats. Open your eyes and wallets and thank the people who are unconditionally cleaning up your mess!

Bill would allow drivers with traffic debt to keep license

Posted: 16 Jan 2020 05:00 AM PST

ANNAPOLIS, Md. —Maryland Attorney General Brian Frosh is backing bipartisan legislation that would allow a driver who owes a traffic debt to keep their license.

Paying a traffic ticket is not always high on the priority list -- sometimes people put it off to pay other bills -- but if you don't pay it, the consequences are severe. Frosh said Wednesday that tens of thousands of people get their licenses suspended because they didn't pay a ticket or fee.

Jason Butler, of Baltimore, spent a month in jail for driving with a suspended license. He initially got a traffic ticket for failing to signal. When he didn't pay, the fine and court costs mounted.

Hunter Biden tops GOP Senate impeachment witness wish list

Posted: 16 Jan 2020 04:00 AM PST

Senate Republicans say Hunter Biden, former Vice President Joe Biden's son, is the first person they think the President Trump's defense team should call as a witness if they get a chance in the upcoming impeachment trial of Trump.

Seven House managers named by House Speaker Nancy Pelosi on Wednesday will present their case in the Senate trial, set to start Jan. 21. It's an open question whether they'll get to call witnesses to bolster their case for two impeachment counts against Trump in the Ukraine military aid affair.

Senate Democrats are clamoring for witnesses, starting with former Trump administration national security adviser John Bolton. Senate Minority Leader Chuck Schumer of New York also wants testimony from acting White House chief of staff Mick Mulvaney, Associate Director for National Security at the Office of Management and Budget Michael Duffey, and administration official Robert Blair.
