Posted: 24 Sep 2016 08:30 PM PDT Jury in EEOC Suit Says Dollar General Must Pay Former Employee Over $277,565 For Disability Discrimination KNOXVILLE, Tenn. - A federal jury has found in favor of the U.S. Equal Employment Opportunity Commission (EEOC) in a federal disability discrimination lawsuit against the retail giant Dollar General, the federal agency announced today. EEOC had charged Dollar General with firing a cashier at its Maryville, Tenn., store because of her need to treat her diabetes. According to EEOC's suit, the cashier, an insulin-dependent diabetic, told her supervisor she was a diabetic and requested on several occasions that her supervisor allow her to keep juice near the register to prevent a hypoglycemic attack. At trial, the cashier testified that her supervisor told her that Dollar General did not allow employees to keep food or drink near the register. Although Dollar General had an accommodation policy that could have allowed the cashier to keep juice near the register, the employees, including management at the Maryville store, did not know about the policy. While alone in the store one day, the cashier drank orange juice prior to purchase, in violation of Dollar General's "grazing" policy, in response to symptoms of a hypoglycemic attack and to protect the store. As soon as the medical emergency passed, the cashier paid for the bottle of orange juice that cost $1.69 plus tax. Later, the district manager and loss prevention manager appeared in the store to address inventory shrinkage and fired the cashier after she admitted to drinking orange juice prior to purchase. The store fired the employee even though it knew she drank the orange juice because of her diabetes and that she had requested to keep juice near the register. EEOC filed suit (Civil Action No.3:14-CV-441) in U.S. District Court for the Eastern District of Tennessee) against Dolgencorp, LLC, dba Dollar General Corporation, on Sept. 23, 2014, after first attempting to reach a pre-litigation settlement through its conciliation process. The discrimination victim joined the suit as a plaintiff in her own personal lawsuit on Dec. 18, 2014. The jury returned a verdict on Friday afternoon for EEOC and the victim, awarding the former cashier $27,565 in back pay and $250,000 in compensatory damages. "We are very pleased with the jury verdict," said EEOC General Counsel P. David Lopez. "It is disappointing, however, that we continue to see cases where employers fail to train their employees on basic requirements under the ADA. The Commission will continue to carry out its goal of ensuring equal opportunity in the workplace for persons with disabilities." EEOC Regional Attorney Faye A. Williams added, "This case highlights another employer who failed to train its employees on the reasonable accommodation requirements under the ADA. Dollar General represents one of the largest variety retailers in the country. Yet it failed to ensure that its employees and management staff knew about its reasonable accommodation policy. It was as if Dollar General had no policy at all. Instead of accepting responsibility for its inaction, Dollar General argued the employee did not need an accommodation. We hope this jury verdict sends a message to its employers, train your employees on the reasonable accommodation requirements under the ADA." Dollar General is the nation's largest small-box discount retailer. It is a convenience store offering major brands with many of its products costing a dollar or less. The company operates over 11,000 stores nationwide, and the corporate headquarters are in Goodlettsville, Tenn. There is just one problem: violent criminals looting, attacking bystanders, attacking journalists, setting fires, smashing up cars, smashing up businesses and shooting at each other is not the a "peaceful protest." Four Powerboats Added To Cruisin Parade Posted: 24 Sep 2016 06:30 PM PDT OCEAN CITY — The grand spectacle of offshore powerboat racing returns to Ocean City in early October and this time race enthusiasts will have the opportunity to view the powerful boats up close and personal with a handful participating in the annual Endless Summer Cruisin' parade on the Boardwalk. Offshore powerboat racing has been a staple of the resort's shoulder seasons off and on for the last decade or so with the Offshore Powerboat Racing Association (OPA) making stops in the resort as part of its summer-long racing series. Because of the timing of the summer season in Ocean City and the need to close off a vast area of ocean to accommodate the racing, the OPA typically puts its Ocean City stop near the end of its schedule and this year is no different. Over the weekend of Oct. 7-9, the OPA will host its penultimate event of the summer series with the Ocean City Grand Prix in advance of the world championships in Florida a week later. Entry Deadline Announced For Berlin’s Annual Christmas Parade Posted: 24 Sep 2016 05:30 PM PDT BERLIN — Berlin's 46th Annual Christmas Parade will be held Thursday, Dec. 1, at 7 p.m. The parade rain date is Dec. 8. The parade officially kicks off numerous Christmas events scheduled for December in Berlin. This year's parade theme is "Christmas Dreams". The parade is sponsored by the Berlin Main Street program, in cooperation with the merchants of the town. All costs of conducting the parade are covered by donations from Berlin area merchants and entry fees. Due to the increased costs, most categories will be asked to pay a small entry fee of $10. Commercial entries will cost $25. Due to time constraints, this year's parade will be limited to 80 entries. Entries are reminded that the parade route will be the same as last year. Haitian immigrants cross border through Mexico, claim asylum for quick processing and entry Posted: 24 Sep 2016 05:00 PM PDT Haitian immigrants are surging across America's southwest border, blazing a path through Mexico to the U.S., where they have been coached to claim asylum, earning them quick processing and almost immediate entry into the country. Analysts called it a backdoor amnesty that's increasingly being abused by illegal immigrants who normally would have no shot of staying in the U.S., but who, by claiming asylum, can gain a foothold here. The Haitians are the latest to discover the route, likely encouraged by smugglers who stand to make thousands of dollars from each migrant they transport through Mexico and up to the U.S. land border. OC’s Newest Beach Play Structure Needs Exterior Repair Posted: 24 Sep 2016 04:30 PM PDT OCEAN CITY — Months after it was added as a new play structure on the beach at Somerset Street, Wally the Whale apparently is already in need of a facelift. Last January, the Mayor and Council approved Wally the Whale as the newest addition to the downtown beach at Somerset Street adjacent to the Boardwalk area. The play structure includes a whale's head emerging from the sand on one end and its tail protruding from the beach at the other end. It includes barnacle-like fixtures on the head and tail, allowing kids and presumably adults, to climb on the structure. The newest addition to the beach toy collection on the beach in the downtown area was installed this spring, but after a full summer under its belt, it already needs some rehabilitation. During his report on the Recreation and Parks Committee meeting last week, Councilman Dennis Dare told the Mayor and Council on Monday the whale structure was due for a renovation after just a few months in the often harsh beach conditions. Last Oct. 10, life changed quickly for Berlin residents Steve and Jayme Isett when the couple's then-5-year-old daughter Sarah was flown from Atlantic General in Berlin to Johns Hopkins in Baltimore in critical condition with acute renal failure. Sarah was taken to AGH when she complained of not feeling well and after a battery of tests on the child, it was determined she needed specialized care for a critical condition provided by only a handful of hospitals in the region. In order for Sarah to receive immediate healthcare from a pediatric nephrologist, the emergency room doctor at AGH made arrangements with the private-sector Air Methods Corporation to fly the child via helicopter to Hopkins in Baltimore. Hopkins Hospital's regular non-profit vendor was on another call and not available, so the AGH doctor made arrangements with Air Methods to transport Sarah to Baltimore in those critical, but potentially life-changing moments. What the Isetts didn't know in those critical moments is that the 45-minute helicopter flight from Berlin to Baltimore would cost them $55,000, or roughly the same amount as her entire three-week stay at Hopkins including the operating room and the intensive care unit. "These funds are essential to help outfit our brave volunteer firefighters across the state," Maryland Fire Supervisor Monte Mitchell said. Troopers Investigating fatal Motor Vehicle Crash – Milford Posted: 24 Sep 2016 07:18 AM PDT Milford, DE- The Delaware State Police Collision Reconstruction Unit is currently investigating a fatal motor vehicle crash which has claimed the life of a 55 year old Milford man. The initial investigation has determined that the crash occurred on Friday, September 23, 2016, at approximately 6:39 p.m., as Gary L. Ingram, 55, was operating a 2012 Kenworth 999 flatbed tow truck and was traveling in a southbound direction on Bay Road (US 113) south of Cicada Lane, Milford. For an unknown reason the tow truck gradually travelled off of the west edge of the roadway where the right side mirror and right corner of the flatbed struck a steel sign. The truck continued traveling in a southbound direction where it then struck a group of trees before coming to rest. Gary Ingram, who was properly restrained at the time of the crash, was treated at the scene by Kent County Paramedics. He was then transported to the Milford Memorial Hospital where he was subsequently pronounced dead. This crash remains under investigation by the Delaware State Police. Neither alcohol or drugs appear to be a factor in this crash. Bay Road was closed for approximately 2.5 hours as the crash was investigated and cleared. That muscle turns the eye in the direction away from the midline. It comes out of the base of the brain and runs along the floor of the skull, immediately beneath the brain before coursing upward to the eye. Dysfunction of that muscle causes the striking picture of the eyes not aiming in the same direction and causes the patient to suffer double vision. From when I started there in 1968 I learned a lot about merchandising and the operation of a retail store. I eventually became the manager of and buyer for the Stag Shop. This was located on the second floor of the downtown store and catered to the teen crowd. I developed a good following of both boys and girls. Realizing that a boy's size 16 would fit a girl that usually wore a size 7, I pointed out that the boys shirts were only $7 and were made much better, if they didn't mind having to button them the opposite of what they were used to. The same held true with the very poplar jeans of the era. A simple tuck at the waist of a pair of 29-29 jeans and you had a perfect size 7. The days of the Stag Shop ended when the new Mall was built on Civic Avenue. It also ended my dream job. I lost my manager's position and became a salesman on the floor at the Mall. Two big differences were the hours were much different and so was the pay ($1.00 an hour plus 6% commission). Being a commission salesman was not what I envisioned for my future. Being the "young guy", they would put me at the front of the store where I only had a chance to sell socks and underwear. The big ticket items, such as suits and sport coats were in the back. Well, we had moved the entire Stag Shop inventory to the Mall so I was very familiar with it, since I had bought it in the first place. One night, this smallish man came in and wanted a sport coat. He didn't look very impressive but I decided to give him my best effort. There was a nice wool sport coat that had been in inventory for about four years but, since it came from the Stag Shop, it was a size 36 and cut a bit smaller than a regular men's cut. I tried it on him and it fit perfectly. He said it was fine and that was what he wanted. So, I took the coat up to the counter and asked the man if it would be a cash or credit transaction. He said he would have to take it home to get his wife's approval and he would let me know. I explained that I couldn't just let him have the coat and he said "Clem (Mr. Gaskill) always let him take something home for his wife's approval". I figured if he knew Mr. Gaskill he must be O.K. to charge. After all, the coat had been marked down to only $28.00, so I wouldn't be taking that much of a risk. I told him that it was all right for him to take it home for her approval, but I would need a name to keep track of the coat. When he told me it was A. W. Perdue, I nearly died. He could have afforded anything in the store and I sold him the least expensive sport coat we had. But he looked good in it and it fit him great. At least I got that satisfaction. Needless to say, his wife liked the coat and he kept it. A small sale, but better than the guy I spent two hours with and dragged out about $250.00 worth of merchandise before the office said his credit was kaput and I had to put everything back. Taxing the System By Wicomico County Executive Bob Culver Posted: 24 Sep 2016 04:45 AM PDT How many times have you heard the phrase – "Well that's just how we've always done it..."? It's not an expression I enjoy hearing. And since I've been elected County Executive, I've heard that expression a lot. Take the way we handle delinquent taxes owed on a property. The county has always mailed a bill in early July and the taxpayer has until the following June to pay their taxes in full. If they don't pay their taxes in full, then the property could be sold at a tax sale. But surprisingly, little to no effort is made throughout the year to collect those taxes. Think about that for a minute. When you have an overdue bill, don't you get several letters from your creditor reminding you to pay? You might even get a phone call to remind you that the bill is due and suggestions on how to conveniently pay the bill. But in Wicomico County, this was rarely if ever done. Until this year. Our new Finance Director, Leslie Lewis, has been reaching out to our delinquent taxpayers and through letters and phone calls, and has had some astounding success in actually collecting that money. One commercial property owner has finally paid all delinquent taxes for the first time in over a decade. And many county residents have been appreciative of that effort and have been paying their taxes. So to date, we have collected $3.6 million more in real estate taxes than this time last year. So I canceled the tax sale this year. That one decision alone has saved the county a lot of taxpayer money. Now there will be those who object to this and I understand that. Some people made a lot of money off the tax sale. One local newspaper made more than $75,000 just in advertising. Lots of investors, mostly attorneys from across the Chesapeake Bay, made lots of money buying up debt that they then usually sold back to the same taxpayers with a nice hefty amount of interest attached. If any municipality wants to have their own tax sale, to recoup taxes owed their town, they are welcome to do so. All of these delinquent properties are still for sale, by the way. Anyone can go to the County Finance Office website and see which properties are for sale and purchase them at the Finance Office downtown. For some reason, the county hadn't offered this option, so the tax sale was the only way investors were able to buy up these properties, in many cases for way less than what they were worth. By law, the county has to have a tax sale on delinquent properties at least every two years, so one will certainly be scheduled for next June. I mean, leave aside her antipathy for the First and Second Amendment and her complete and utter inability to relate to average people: don't you know she's a "style icon"? Hard to disagree with that. It's really tough to figure out my favorite Hillary look. Who can forget Burlap Sack, from The Derelicte Collection? Stylish and functional! It's good that she was dressed up to withstand the heat of the Earth's molten core; after all, anything above a scorching 75 degrees or so puts her at risk of fainting. All that foil and that not-at-all-ridiculous-or-awful collar will help deflect the glare of the lights. How could this beacon of light possibly lose? She's just so great and Trump is just so terrible—the late night talk shows say this all the time, so it must be true and their echo chamber is definitely not backfiring at all. People are definitely NOT tired of being told that Hillary is the best and that they're racist, deplorable yokels for supporting Donald Trump. Posted: 24 Sep 2016 03:30 AM PDT OCEAN CITY — While there were the typical complaints regarding noise and traffic, resort officials this week said OC BikeFest last week was a success and the new ordinance on trailer and oversized vehicle parking certainly appeared to achieve the desired results. Over 150,000 motorcyclists roared into the resort starting mid-week last week for OC BikeFest, bringing with them the requisite noise and traffic. The event, criticized in some circles, also put thousands of heads in beds and patrons in restaurant seats and had a direct impact on Ocean City's room tax and sales tax bottom line. It's a fine line tiptoed by the resort, which continues to strive for an improved quality of life for its residents and visitors, while helping to balance the books on the back of offseason special events. While there was the typical criticism of some facets of the event, Mayor Rick Meehan said this week OC BikeFest largely went off without a hitch. "We had a very busy weekend and I think it went extremely well," he said on Monday. "I think the police department had a good plan in place and I thank you for that. I don't know of any serious incidents and with all of the people in town and all of the motorcycles, I think it went very well. The extra police presence certainly helped us." The city buttoned down for a third night of violence Thursday, with National Guardsmen joining the thinning blue ranks to impose restraint if not order. You can unknowingly prolong your financial lull by continuing to make bad financial decisions, i.e. spending money when you should instead be cutting back your spending. You may try to justify certain purchases, rationalizing that you "need" it or that life will be too uncomfortable without it. But, more often than not, you'll be just fine without those extra purchases. Check out a list of things you shouldn't do when you're broke. Take out a loan for a new car, or for any other reason. If you're broke, you can't afford another monthly payment and that's exactly what you're adding to your plate when you take out a loan. Go on an expensive vacation. You're broke, you can't afford a vacation. If you have money saved up for a vacation, there's probably something more pressing you could spend that money on—like past due bills or car repairs, for example. Loan money to someone else, or cosign for them. Having no money for yourself means you also don't have money for anyone else. Police: 4 women dead in Wash. mall shooting; suspect on the loose Posted: 24 Sep 2016 01:18 AM PDT SEATTLE A gunman opened fire in a crowded mall north of Seattle, killing four people and critically wounding another before fleeing Friday night, authorities said. Francis said police were searching for a Hispanic man wearing black and armed with a rifle who was last seen walking toward Interstate 5. "We are still actively looking for the shooter. Troopers Arrest Rehoboth Beach Man after Drug Investigation Posted: 24 Sep 2016 12:30 AM PDT Rehoboth Beach, DE – The Delaware State Police Sussex Drug Unit have arrested Garrett M. King, 33 of Rehoboth Beach, after the investigation revealed illegal drug sales from his residence in Rehoboth Beach. On, Tuesday, September 13, 2016 the Delaware State Police Sussex County Drug Unit and the Rehoboth Beach Police Department concluded a one month drug investigation after receiving information that Garrett M. King was selling quantities of cocaine from his residence. A search warrant executed of his vehicle during a traffic stop, on Scarborough Avenue in the limits of Rehoboth Beach, uncovered over 20 grams of powder cocaine, 7.2 grams of marijuana, a digital scale, handgun, shotgun, rifle and over $500.00 in suspected drug proceeds. A search warrant executed at his residence, located in the unit block of Hickman Street, Rehoboth Beach, revealed drug paraphernalia and various types of ammunition. King was taken into custody during the traffic stop. Garrett M. King, 33 of Rehoboth Beach, was transported to Troop 7 in Lewes where he was formally charged with the following as a result of the investigation: PWITD Tier 4 Cocaine, Possession Firearm by Person Prohibited, Possession Drug Paraphernalia, and Possession of Marijuana.
