Cop who shot man after mistaking his apartment for her own made "unreasonable errors," prosecutor says

Posted: 23 Sep 2019 07:00 PM PDT

A former Dallas officer who says she fatally shot an unarmed black man in his own home after mistaking his apartment for her own made a series of "unreasonable errors" and worried more about how the incident would affect her than about the man she shot, a prosecutor said in opening statements of her murder trial Monday.

Amber Guyger, who is white, is standing trial for the killing of 26-year-old Botham Jean last year.

Guyger was returning to the Dallas apartment complex where she lived in an apartment on a different floor from Jean after working a 13-and-a-half-hour shift September 6, 2018, a prosecutor said. Guyger was off-duty but still in uniform when the shooting happened. She told investigators that she parked on the fourth floor of her apartment complex's garage — rather than the third floor, where she lived — and found the apartment's door ajar.

Jean, an accountant from the Caribbean nation of St. Lucia, "was doing no harm to anyone, which was his way," Dallas County Assistant District Attorney Jason Hermus said in an opening statement. He noted that Jean was in his living room eating a bowl of vanilla ice cream when Guyger entered the apartment, which was one floor directly above her apartment.

Most St. Louis Prosecutors Quit Or Were Fired Since Anti-Cop Prosecutor Started

So many prosecutors have quit since Kimberly Gardner became circuit attorney that the office is in a total mess.

St. Louis, MO – More than 65 prosecutors have left the St. Louis Circuit Attorney's Office, an over 100% turnover rate, since Kimberly Gardner took over two-and-a-half years ago.

Some attorneys quit and others were fired, but they took with them a combined 470 years of prosecutorial experience, leaving the office in really bad shape, the St. Louis Post-Dispatch reported.

Former staffers said the office was suffering from low morale and a shortage of legal wisdom and is in a state of total dysfunction.

"It's not normal to lose that many people," former Assistant Circuit Attorney Jeff Ernst told the St. Louis Post-Dispatch.

Driver’s License Bribery Scheme Leads To Guilty Pleas

Posted: 23 Sep 2019 04:30 PM PDT

An employee of the state Division of Motor Vehicles and a man who bribed her have pleaded guilty to issuing drivers' licenses to people who hadn't earned them. Danielle Haldeman, 29, of Greenwood, who worked at the DMV facility in Georgetown, accepted bribes from Michelet Pouloute, 44, of Dover, who served as an interpreter for recent non-English speaking immigrants. Pouloute would give Haldeman cash, and then Haldeman provided licenses despite the recipients not having proper documentation or testing in a scheme that lasted from August to mid-October 2017. Haldeman pleaded guilty to 1 count of Felony Receiving a Bribe, as well as 1 count of Misdemeanor Official Misconduct. Pouloute pleaded guilty to 1 count of Felony Bribery. Each were sentenced by a Superior Court judge to 1 year of probation and restitution to their victims. All 41 of the licenses have been cancelled and returned to the DMV. DOJ's Office of Civil of Rights & Public Trust, the Division of Motor Vehicles, and Delaware State Police worked together on the investigation and prosecution. DOJ paralegal Trisha McGinnis assisted with the prosecution.

An ongoing effort in Delaware to test previously untested sexual assault kits led to an arrest and guilty plea for a 38-year-old Chester, PA man. Hayim Raison pleaded guilty to 2 counts of Rape Second Degree. DNA evidence revealed that between January 2014 and December 2018, Raison raped 7 women in secluded areas throughout Wilmington, making violent threats in many of the attacks. In order to resolve the case with the certainty of guilty pleas and to not put the victims through the difficulty and uncertainty of a trial, guilty pleas to 2 counts were accepted by prosecutors after consultation with the victims. However, the sentencing process will recognize the attacks against all 7 women and all 7 will have the opportunity to testify before a Superior Court judge as part of the sentencing in January. The US Department of Justice Sexual Assault Kit Initiative (SAKI), along with the Delaware Department of Justice, and local law enforcement agencies and organizations are committed to bringing justice to victims, identifying offenders and helping to solve more cold cases. Anyone who has had a sexual assault kit collected and would like more information should contact the Delaware Victims Center at 1-800-VICTIM1 or the Delaware Criminal Justice Council, SAKI Coordinator at 302 577-8717 or cjc.delaware.gov. All victims of Sexual Assault can receive support and information by calling the following Rape Crisis Hotlines 24/7: New Castle County and Sussex County – YWCA SARC at 1-800-773-5870, Kent and Sussex County – Lifeline Rape Crisis at 1-800-262-9800.

A New Castle County Superior Court jury convicted a Pennsylvania man for sexually assaulting a child. Darth Heald, 41, of Honey Brook, PA was convicted of Sexual Abuse of a Child by a Person in a Position of Trust, Supervision or Authority Second Degree, Dangerous Crime Against a Child, Unlawful Sexual Contact First Degree, and Unlawful Imprisonment Second Degree. In September 2018, Heald was staying with family members in Delaware and inappropriately touched a child who was in the house playing with children who lived there. Deputy Attorney General Cari Chapman prosecuted the case with DOJ social workers Lisa Rapko and Claudia Melton, paralegal Jayna Quillen, senior administrative assistant Monica Walker, special investigator, Brian Daly, and Detective Kevin Mackie of the New Castle County Police Department. A Superior Court judge will sentence Heald in January.

The man who drove the getaway car from an armed robbery in Wilmington has pleaded guilty. In September 2018, Ronald Comeger, 34, of Wilmington, waited in his car outside of Ainsley's Pharmacy in the Miller Road Shopping Center, while Lance Parker, 28, of Wilmington, was inside stealing narcotics at gunpoint and then locking three employees in a secure cage meant to store drugs. A clerk at the pharmacy put a tracking device in the bag of prescription bottle that Parker stole, and Wilmington and State Police stopped the car a short time later. Police took Parker into custody at the scene, and arrested Comeger a few blocks away when he tried to run. Comeger pleaded guilty to Kidnapping First Degree, Robbery Second Degree, and Conspiracy Second Degree. A Superior Court judge will sentence Comeger in January. Parker pleaded guilty in April to Possession of a Firearm During the Commission of a Felony, Robbery Second Degree, and Conspiracy Second Degree, and will be sentenced later this month. Deputy Attorneys General Joseph Grubb and Matthew Hicks prosecuted the cases with the assistance of DOJ social worker Kristen Fluharty-Emory.

Michael Grendell filed a $120 million lawsuit following the 20-hour standoff with Maine State Police.

Bangor, ME – A suspect who allegedly shot at police after initiating a 20-hour standoff has filed a $120 million federal lawsuit against the state, alleging that Maine State Police (MSP) interfered with his rights and discriminated against him.

Michael Grendell, 62, claimed the MSP used excessive force by bombing his home and shooting him in the torso and face after authorities say he shot at officers and then refused to drop his firearm after he emerged from the residence, the Bangor Daily News reported.

"No reasonable officer or supervisor could have concluded that robot/bombing Michael Grendell's home and person and then shooting him in his further disabled state, were in any way constitutionally or legally justified," the lawsuit read.

"We proudly declare Pratt Industries and the great, great state of Ohio open for business . . . Pratt has pledged, as I said, to invest many billions in the United States," the President said to a "U-S-A"-chanting crowd.

"Pratt is creating 5,000 new jobs, helped in part by Trump's tax cuts which included lowering the corporate tax rate to 21 percent from 35 percent," O'Halloran writes. "Trump noted foreign companies invested $250 billion in the United States last year alone."

Attorney General Frosh Joins Coalition Urging Congressional Action to Close Ammunition Sale Loophole

Posted: 23 Sep 2019 03:00 PM PDT

Jaime's Law Extends Background Check Requirements to Include Ammunition sales

BALTIMORE, MD (September 23, 2019) - Maryland Attorney General Brian E. Frosh today joined a coalition of 20 other attorneys general in sending a letter to Congressional leaders urging support of legislation extending existing background check requirements on firearm sales to also include ammunition sales. The attorneys general argue these background checks would decrease gun violence by stopping individuals who are prohibited from purchasing a gun from also obtaining ammunition.

"People looking to buy ammunition should be subject to the same requirements that are already in place for firearm sales," said Attorney General Frosh. "This common sense legislation will close a gaping loophole and add another crucial piece to the strategy of reducing gun violence in our communities."

Jaime's Law is named after 14-year-old Jaime Guttenberg, one of 17 students and teachers killed in a mass shooting at Marjory Stoneman Douglas High School in Parkland, Florida. The bill would make it illegal for individuals who are already "prohibited purchasers" under federal law - including convicted felons, domestic abusers, and individuals with serious mental health conditions - to purchase or possess ammunition.

To enforce this requirement, individuals would either have to be licensed to own a firearm or undergo a background check to purchase ammunition. Federal law already places these requirements on firearms sales; extending those same requirements to ammunition can reduce gun violence and suicide.

Jaime's Law is currently before the House Judiciary Committee. In their letter, the attorneys general ask the Committee to give the bill their support and urge the House and the Senate to ensure this important bill is passed to support law enforcement and public safety.

In addition to Maryland, the letter was signed by the attorneys general of California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Iowa, Massachusetts, Michigan, Minnesota, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, and Washington.

American "economic refugees" are increasingly retiring abroad

Posted: 23 Sep 2019 02:00 PM PDT

Cynthia and Edd Staton are thoroughly enjoying retirement in their 3,000 square-foot penthouse apartment. They have a housekeeper, eat out frequently, never fret about health care costs, and indulge in yoga classes and visits to the gym. It's a fine way to spend their golden years — in Ecuador.

The Statons said the decision to retire outside the U.S. came in the wake of the financial crisis a decade ago, when their retirement nest egg lost value and they were faced with retiring at a lower standard of living than they had expected. More Americans have followed their lead. The number of retirees who draw Social Security outside the U.S. jumped 40%, to more than 413,000, between 2007 to 2017, according to the Social Security Administration.

To be sure, that's a fraction of the nation's 42 million retirees. But it reflects the financial realities for a growing number of baby boomers who are hitting 65 without enough money stashed away to maintain their standard of living. The median retirement savings for people in that age group is $152,000 — the highest of any working generation — but 1 in 5 say they haven't yet recovered from the recession and never may, according to the Transamerica Center for Retirement Studies.

Asteroid dust could fix global warming, scientists say

Posted: 23 Sep 2019 01:30 PM PDT

WASHINGTON — A group of Swedish researchers believe that a cataclysmic asteroid collision from hundreds of millions of years ago could have the answers to solving climate change.

The international study examines the aftermath after a huge asteroid was crushed between Jupiter and Mars sending large amounts of dust through the solar system. The dust had a "blocking effect" on sunlight reaching Earth, causing an ice age and creating climate zones on Earth. Before this, the Earth is said to have had a more homogeneous environment.

Researchers have been discussing different artificial methods of recreating post-collision asteroid dust, such as placing asteroids in orbits around Earth like satellites and having them "liberate fine dust" to block warming sunlight, thus hypothetically cooling our warming planet.

Lauren Boebert, the Colorado restaurant owner who confronted Democratic presidential candidate Beto O'Rourke about his gun control proposals during a Thursday town hall, discussed the issue on Saturday morning's "Fox & Friends."

"I am here to say hell no, you're not," Boebert, who owns a pro-Second Amendment restaurant called Shooters Grill, told O'Rourke on Thursday. "I have four children. I'm 5 foot zero, 100 pounds, cannot defend myself with a fist. I want to know how you're going to legislate that, because a criminal by defense breaks the law. So all you're going to do is restrict law-abiding citizens like myself."

In addition to discussing what led her to confront the presidential candidate, Boebert also had a few more words for O'Rourke along with a message for President Donald Trump.

Badrun Khan, the Democratic activist challenging Democratic New York Rep. Alexandria Ocasio-Cortez in a primary fight to represent the state's fourteenth congressional district, spoke to Fox News anchor Martha MacCallum in her first televised interview Thursday evening.

NY judge fines landlord $17,000 for threatening to call ICE on tenant

Posted: 23 Sep 2019 09:30 AM PDT

A New York judge fined a landlord $17,000 for threatening to call Immigration and Customs Enforcement officers on a tenant who was in the country illegally.

Holly Ondaan, 48, lived in Dianna Lysius' Jamaica, Queens property dating back to 2011, but she stopped paying her rent, according to the Wall Street Journal. Lysius started the eviction process for her tenant in January 2018. Lysius sent a text to Ondaan threatening to call ICE officials, and included a link to an article about ICE officers raiding a 7/11.

New York's Commission on Human Rights filed a complaint against Lysius to an administrative judge. The judge ordered her to pay a $5,000 fine to the city and $12,000 in damages to the tenant on Sept. 12.

Lawyers for the commission suggested this could be the first time where a person was fined for threatening to call immigration officials on someone in the country illegally.

'A blunt remedy': Adam Schiff threatens to defund intel community over Ukraine whistleblower

House Intelligence Committee Chairman Adam Schiff threatened to defund the intelligence community if his committee is not provided with the whistleblower complaint regarding President Trump's interactions with Ukraine.

A whistleblower complaint alleging Trump improperly made a "promise" with Ukrainian officials has lately dominated the news cycle, and additional reporting has suggested that Trump urged the foreign government to investigate his potential 2020 opponent Joe Biden.

Schiff appeared on CNN's State of the Union Sunday morning, during which host Jake Tapper asked him if he'd be willing to hold up funding for the intel community to see the full complaint.

"It depends on what funds we withhold," Schiff replied. "In this case, you have the Office of the Director of National Intelligence that is withholding this complaint in violation of the clear letter of the law ... And there are funding requests that that office makes that don't go directly to national security that we can withhold."

Schweizer: Media Trying to Turn a Biden Scandal into a Trump Scandal

"They're trying to turn what was a Biden scandal into a Trump scandal," Peter Schweizer said of the Washington Post's and other news media outlets' framing of a "whistleblower" making headlines this week, offering his remarks on Friday's edition of SiriusXM's Breitbart News Tonight.

President Donald Trump reportedly urged Ukrainian president Volodymyr Zelensky to look into former vice president Joe Biden's son — Hunter Biden — and his business dealings in the eastern European country, according to a Friday-published Wall Street Journal report. The allegation follows reports that a whistleblower filed a complaint in relation to the president's communications with Ukraine.

Schweizer said, "Hunter Biden, in a sense, went around the world and cashed in on his father's access. One of those places was in Ukraine, [with] an energy company named Burisma, which is headed by a very corrupt oligarch named Zlachevsky, [that] hired him as an advisor and a board member in April of 2014."

Schweizer continued, "What's interesting about this is that Hunter Biden has no background in Ukraine. He has no background in energy or natural gas or anything like that, but of course his father, the vice president at the time, was the point person on U.S. policy towards Ukraine, and the money we're talking about here is eye-popping. Hunter Biden was getting $83,000 a month from this Ukrainian energy company where he had no background."

Infuriating Report Reveals DMVs Across The US Are Selling Your Personal Info & Making Millions

Posted: 23 Sep 2019 07:30 AM PDT

Anyone who has ever had to stand in a long line to pay the state for the privilege of renewing your driver's license knows how infuriating that experience can be. The bureaucratic high-horse mentality of many of the DMV workers is so brazen and overt that DMVs have earned a notoriously horrid reputation in every state. But more infuriating than long lines and power-tripping bureaucrats, however, it the fact that according to a new report, these power-tripping bureaucrats are selling your data to private entities.

And they are making millions doing it.

According to a scathing report from Motherboard, government-run motor vehicle departments across the country are taking your personal information—entrusted solely to them by you—and selling it to the highest bidder. These sales are netting DMVs across the county millions in profits.

Ever wonder where all these spam calls for credit cards and vehicle warranties come from? Well now you have likely found the culprit, and it's the government.

While it is understood that DMVs can sell information for legitimate purposes to insurance companies, many of these sales were to nefarious entities, according to the report.

When most people go to the DMV, they most likely think that their information is safe. However, according to the report, which was comprised of multiple public records requests, after you give your personal information to the DMV, they turn around and sell it to almost anyone who asks.

Schweizer: Hunter Biden Helped China Buy Our ‘National Security’ Assets

Posted: 23 Sep 2019 07:00 AM PDT

Hunter Biden, Joe Biden's second son, helped facilitate China's acquisition of Henniges Automotive explained Peter Schweizer, president of the Government Accountability Institute and senior contributor at Breitbart News, in a Friday interview on SiriusXM's Breitbart News Tonight.

He called the Senate Finance Committee's decision to probe the Obama administration's 2015 approval of the sale of Henniges Automotive as a "wonderful development."

Schweizer examined China's acquisition of Henniges Automotive — a formerly America-based company developing "dual-use" technologies with military applications — by Aviation Industry Corporation of China (AVIC), a Chinese state-run military contractor. AVIC acquired Henniges in 2015 with a 51 percent stake purchase. The remaining 49 percent was purchased by Bohai Harvest RST (BHR), a private equity firm founded by Hunter Biden and funded with $1.5 billion from the Chinese government via the Bank of China.

Hypocrats resist targeting gang databases with 'red flag' laws

Posted: 23 Sep 2019 06:45 AM PDT

House Democrats this week advanced a new measure to encourage states to pass "red flag" laws, known as extreme risk protection orders, that authorize removing guns and ammunition from dangerous individuals.

Democrats on the House Judiciary Committee amended the measure during a Wednesday mark-up to authorize the federal government to issue extreme risk protection orders in some instances, but they rejected an amendment that would have red-flagged anyone who law enforcement lists as a gang member.

"The majority of violent crime, including gun violence, in the United States is linked to gangs," Rep. Ken Buck, a Colorado Republican who sponsored the amendment, said Wednesday. "My amendment is quite simple. It would allow the issuance of a red flag order against anyone whose name appears in a gang database if there was probable cause to include that individual in the database."

Democrats objected with reasons that sounded very familiar to Republicans.

ICE-Hating Groups Used Facebook to Incite Violence

Posted: 23 Sep 2019 06:30 AM PDT

Abolish ICE thugs in Colorado want to see the homes and families of immigration enforcement officials set aflame.

Denver communists want alien detention facility employees dead, swinging from nooses with broken necks.

Both groups are brazenly using Facebook to spread their inflammatory and violent messages.

So, where is Silicon Valley—whose top companies partner with the Southern Poverty Law Center smear machine to de-platform conservatives, pro-lifers, and Donald Trump supporters—to stop the open borders left's escalating hate?

On Thursday, Sept. 19, Abolish ICE Denver and the Denver Communists are organizing a protest outside the house of Johnny Choate, the warden of the immigrant detention facility in Aurora, Colorado.

Choate works for GEO Group, which operates the center.

Football Game Canceled Ahead of Rally for Cheerleaders Punished for Trump Banner

Posted: 23 Sep 2019 06:15 AM PDT

A North Carolina school district canceled a football game on Friday ahead of a rally to support cheerleaders put on probation for holding a Trump 2020 banner at a game in late August.

The North Carolina High School Athletic Association (NCHSAA) said it canceled the game at North Stanly High School because "Stanly County Schools has been notified of additional information that could compromise safety measures our schools have in place for sporting events," according to the Charlotte Observer.

However, that did not stop the cheerleader's supporters from continuing with their plans to hold the rally outside the school's football stadium in New London on Friday.

On September 17, Breitbart News reported that the cheerleaders were placed on probation after they posted a pre-game photo of themselves holding the pro-Trump banner on social media.

Trump charges media with protecting Biden on Ukraine story

Posted: 23 Sep 2019 06:00 AM PDT

President Trump said Saturday the media is "fabricating" a story about him pressuring the president of Ukraine to investigate the son of Democrat frontrunner Joseph R. Biden, while ignoring a story about Mr. Biden essentially blackmailing Ukrainian leaders to lay off his son.

"The Fake News Media and their partner, the Democrat Party, want to stay as far away as possible from the Joe Biden demand that the Ukrainian Government fire a prosecutor who was investigating his son, or they won't get a very large amount of U.S. money, so they fabricate a story about me and a perfectly fine and routine conversation I had with the new President of the Ukraine," Mr. Trump said in a tweet.

Campaigning in Iowa, Mr. Biden angrily accused the President Saturday of "using every element of his presidency to try and smear me." He called for an investigation into Mr. Trump's phone call with the Ukrainian president.

"You should be asking him the question: Why is he on the phone with a foreign leader, trying to intimidate a foreign leader?" Mr. Biden said. "This appears to be an overwhelming abuse of power. The House should investigate. To get on the phone with a foreign leader who is looking for help from the United States and ask about me and imply things … this is outrageous. You have never seen anything like this from any President."

Mr. Biden angrily jabbed his finger at a reporter who asked if he had ever spoken to his son about his foreign business dealings, and said he hadn't.
